Readers who are receiving gift cards previously filed a claim with a Pennsylvania Walmart coupon class action settlement. The settlement resolved class action claims that the company wrongfully charged non-discounted sales tax on discounted purchases.

Plaintiff Brian Farneth filed his Walmart coupon class action against the retailer after allegedly being charged non-discounted sales tax. He reportedly purchased two cans of shaving cream from Walmart using a buy-one-get-one gift card.

Despite using the gift card, Farneth was allegedly charged sales tax on both items rather than only one.

Farneth originally filed the Walmart class action lawsuit in state court but it was subsequently removed to federal court. Later on, the suit was remanded to state court after a federal judge determined that a state court would be able to better handle the class action claims.

Walmart later agreed to pay between $21.5 million and $45 million to resolve the class action claims against them. However, the global retailer did not admit any wrongdoing under the settlement. Instead, Walmart settled in order to resolve the claims and avoid the costs and risks of continued litigation.

The settlement benefited consumers who used a coupon while purchasing a taxable item from a Pennsylvania Walmart between Jun. 8, 2007 and Apr. 15, 2015 but were charged sales tax on the product’s original purchase price.

Under the settlement, consumers were eligible for a gift card. Gift card values were estimated to be between $30 and $100 and would depend on the number of claims submitted. In the end, the gift card payments were valued at $77.61.

According to the settlement website, claimants should have started to receive their gift cards on July 31, 2019. If consumers did not receive a gift card or lost their issued gift card, they can file a request for a replacement by Nov. 21, 2019.

    I received an egift card on 8/1/19 and it was promptly stolen and used at a store 3K miles away from me on 8/3/19. WalMart is investigating.
