- Why: 3M is accused of having excessive levels of benzene in its Ultrathon Insect Repellent that doesn’t appear on the products labeling.
- Where: The 3M class action was filed in federal court in California.
3M Company is facing a class action lawsuit claiming that its Ultrathon Insect Repellent 8 spray has excessive levels of benzene that are not disclosed on the product’s labeling.
The insect repellent was independently tested after the plaintiffs acquired six bottles and all six bottles showed high levels of benzene. The class claims that it suffered economic damages due to the benzene and sought a refund of the full purchase price.
“Defendant knew or should have known that Ultrathon was contaminated with excessive levels of benzene and that testing of the products for benzene was necessary to protect Plaintiffs and putative class members from harmful levels of benzene exposure,” the Ultrathon Insect Repellent class action says. “Defendant failed to appropriately and adequately test Ultrathon for the presence of benzene to protect plaintiffs and the class from benzene exposure.”
Benzene can cause nervous system, reproductive and blood disorder issues or cancer, Ultrathon benzene lawsuit says
Benzene primarily comes from petroleum and it is a carcinogen that has been known to be hazardous for more than 100 years, the Ultrathon benzene lawsuit claims.
Benzene can cause both nervous system issues and reproductive issues, according to the Centers for Disease Control and Prevention, and it increases the risk of leukemia and other blood disorders, the National Cancer Institute says.
Benzene is “known to be a human carcinogen based on sufficient evidence of carcinogenicity from studies in humans” according to the National Toxicology Program.
The manufacturers of Lotrimin and Tinactin brand antifungal spray products are also facing a class action lawsuit claiming they failed to disclose that the products allegedly contain dangerously high levels of benzene.
