A $990,000 Zayo class action settlement has been reached which would resolve allegations that the network infrastructure company illegally obtained biometric information from individuals visiting its Illinois facilities.
If you visited a Zayo Group facility in Illinois between July 6, 2012 and Dec. 27, 2017, and were required to provide a hand, palm, or finger scan for security purposes, you could get $400 from this class action settlement.
Zayo Group is “the leading provider of global communications infrastructure, with deep, high-quality networks throughout the US and Europe,” according to its website.
Lead plaintiff Denis Zhirovetskiy claimed that he and others were required to provide their biometric information to the company upon visiting one of its facilities in Illinois, when the state has limited what can be collected under the Biometric Information Privacy Act, or BIPA.
Under the BIPA, those in Illinois are endowed with certain protections when it comes to their biometric information. Biometric information includes facial scans, fingerprints and handprints used to identify an individual.
The Act requires written notice that biometric information will be collected or stored, along with the specific purpose and length of time that the data will be stored and used.
According to the Zayo hand scan class action lawsuit, the company obtained hand, palm, and fingerprint information for security purposes at its Illinois facilities, but failed to inform individuals as required under the BIPA.
Under the terms of the Zayo class action settlement, Class Members can get cash payments of up to $400.
To make a claim, Class Members must provide their Claim ID and PIN Code provided on the printed or emailed notice they received for the settlement. Those without this information need to contact the settlement administrator at 1-866-458-2106.
Class Members who wish to opt out or exclude themselves from the Zayo hand scan class action settlement must do so by March 8, 2019.

Class Members must either provide their Claim ID and PIN Code to make an online claim or print and mail a Claim Form. Class Members must provide their name, address, phone number, and the names of the Zayo facilities where they provided biometric information on the printed Claim Form.
