Woopla agreed to a $835,000 settlement to resolve a class action lawsuit claiming that it violated state laws by selling virtual currency for real money on its Funzpoints casino game website.

The settlement benefits Kentucky residents who spent $5 or more within a 24-hour period on funzpoints.com between June 27, 2018, and Oct. 29, 2022.

According to the class action lawsuit, Woopla violated Kentucky’s gambling laws by selling in-game currency on funzpoints.com. This currency allegedly allowed gamers to gamble using real money despite the the Funzpoints casino game website not being authorized under state law.

Woopla is a social gaming developer that creates online websites such as funzpoints.com which allow consumers to play games with each other.

Woopla hasn’t admitted any wrongdoing but agreed to resolve the class action lawsuit with a $835,000 settlement.

Under the terms of the settlement, class members can receive a cash payment based on the amount they paid for in-game purchases during the class period and the number of claims filed with the settlement. Players who made larger in-game purchases will receive a greater share of the net settlement fund.

Exact payment estimates are not available at this time, but class members can calculate their general estimated payment based on information on the settlement website. 

Woopla also agreed to take measures to address video game behavior disorders such as self-service player resources and in-game mechanics.

The deadline for exclusion and objection is Nov. 17, 2023.

The final approval hearing for the Woopla virtual currency settlement is scheduled for Dec. 11, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Jan. 29, 2024.
