HSBC class action

HSBC has agreed to pay nearly $40 million to resolve a class action lawsuit accusing the company of violating the federal Telephone Consumer Protection Act (TCPA). If you received a cell phone call from HSBC or through an entity calling on its behalf between 2008 and 2012, you may be eligible to claim between $20 and $40 from the HSBC TCPA class action settlement.

The proposed HSBC TCPA settlement will resolve a class action lawsuit (Wilkins, et al. v. HSBC Bank Nevada, N.A.) that accuses HSBC of using an automatic telephone dialing system or prerecorded or artificial voice when placing cell phone calls between May 31, 2008 and May 1, 2012. These types of telephone calls are illegal under the Telephone Consumer Protection Act, which protects consumers from unwanted or harassing cell phone calls from companies.

HSBC denies the allegations but agreed to establish a $39,975,000 class action settlement fund to resolve the litigation and avoid the expense and uncertainty of going to trial. The settlement fund will be used to award Class Members who submit a valid and timely Claim Form, as well as to pay attorneys’ fees and related costs.

Who’s Eligible

Class Members of the Wilkins v. HSBC TCPA settlement include all persons within the United States who, on or after May 31, 2008 through May 1, 2012, received a non-emergency cell phone call by HSBC Card Services Inc, or any other entity on behalf of HSBC Finance Corp. or HSBC Bank Nevada, through the use of an automatic telephone dialing system or an artificial or prerecorded voice.

Potential Award

$20 – $40 (estimated). Your share of the HSBC TCPA settlement fund will depend on the number of valid claims filed. Class Counsel estimates that the amount of the cash award will fall within this range.

UPDATE: Settlement checks were mailed on May 22, 2015. Viewers are reporting that they have received checks worth about $102 from the HSBC class action settlement. Congratulations to everyone who submitted claims and got PAID!

UPDATE 2: On Jan. 8, 2016, a second round of checks was mailed to Class Members who filed claims for the HSBC TCPA class action settlement.

    The Claims Administrator is GCG, and they are crooks! For example, if you have received at least 2 checks from GCG on different settlements you wont receive a check for this one. GCG is known for not paying out valid claims since they flag for name and address. I wouldnt get my hopes up on this one!

I got a claim number and control number so i know I’m getting paid. You are probably one of these people who fill out a claim form hoping for a free payday, and when you don’t get it you blame the company. Move along now and post somewhere else.

Anyone here who got a claim and control number will get paid, I’m assuming you didn’t so that is the reason for your anger of not receiving money your not entitled to. BTW when i get my check I’m going to take picture of it so you can see what you could of had.

    If all 9,065,262 class members had filed a claim, they would each
    have received $2.95. In this case, however, only 286,433 class members, or 3.16% of the class,
    filed a timely claim, so they will each receive at least $93.22. (Dkt. No. 90 at 3.)

      Checks are for around $101 and if more then 537 checks don’t get cashed or are undeliverable we get that money to in a separate check…Yee Haw

    When did you try to file a claim? I received a claim number and control number in the mail since i was on record for receiving calls. I just had to type those in and my current address.
