We-Vibe app privacy

Parties have reached a settlement in a class action lawsuit over allegedly unauthorized data collection linked to We-Vibe vibrators.

Consumers who purchased a Bluetooth-enabled We-Vibe device or who downloaded the We-Connect smartphone app may be eligible for a settlement payment.

Defendant Standard Innovation Corp. makes and sells a line of vibrators under the We-Vibe brand. These vibrators are designed for use with the We-Connect smartphone app, which allows users to control the vibrator through a Bluetooth link to their smartphone. Use of the We-Connect app is necessary to access all of the We-Vibe vibrator’s features.

Plaintiff N.P. filed this We-Vibe class action lawsuit in September 2016. She alleges Standard Innovation Corp. has been unlawfully collecting data about users’ We-Vibe use and transmitting that data to servers in Canada.

Data collected and transmitted allegedly includes the date and time of each use of the vibrator and the settings used, according to N.P. She claims this data is sent together with the personal email address of the user who registered with the We-Connect app.

All this data collection occurs without the user’s knowledge or consent, N.P. claims.

The parties agreed on a settlement in March 2017. This settlement offers compensation for persons who purchased Bluetooth-enabled We-Vibe products or who downloaded and used the We-Connect app.

Standard Innovation Corp. maintains that its data collection activities have been lawful at all relevant times. The company has not admitted to any fault or liability, and no such determination has been made by the court.

Class Members who want to object to the settlement or opt out must do so by June 29, 2017.

Who’s Eligible

The settlement provides compensation for two plaintiff Classes.

The Purchaser Class includes all persons in the U.S. who before Sept. 26, 2016 bought any of the following Bluetooth-enabled We-Vibe products:

  • We-Vibe Classic
  • We-Vibe 4 Plus
  • We-Vibe 4 Plus App Only
  • Rave by We-Vibe
  • Nova by We-Vibe

The App Class includes all persons in the U.S. who before Sept. 26, 2016 downloaded the We-Connect app and used it to control any of the We-Vibe products listed above.

Many claimants will be members of both Classes.

Potential Award

Up to $10,000

Purchaser Class Members who submit a valid claim will receive a share of the settlement fund of up to $199. App Class Members with a valid claim will receive a share of up to $10,000.

For both Classes, the amount of each payment will depend on the number of valid claims received and on how much of the settlement fund remains after covering plaintiffs’ incentive awards, attorneys’ fees, and notice and administration costs.

Proof of Purchase

Claimants must provide the serial number of their We-Vibe product.

    I submitted a claim a while back but have not heard word if it was received well. Nor have I been contacted in any way. How can I find out if the claim was receive and what the status is of my claim?

      Unfortunately they don’t send email confirmation or mail confirmation of any kind. You should of gotten a number when you put the claim in if it was online I just took a screen shot of it to keep as reference since it did state no email would be provided upon filling it out. Maybe email them and see if they recieved jt?

    I cannot locate the serial number on my product. It is not on the charging case either. Do you know where to find the serial number?

      It is on the actual we vibe. Use a flashlight and look very closely and it is imprinted on it. I had to take a picture and enlarge it.

    will my information (name, email etc.) become public if I file a claim?

    I purchased one for my wife, we both downloaded the app. Do we claim seperate? One of us claims the purchase of the product, and then both of us claim on the download part of the settlement?

      That is my understanding Shawn. At least that is what I am doing. We both downloaded the application and used it a couple of times. Technically, we split the cost of the device, but i think only the one claim for ownership will be valid.
