A judgment has been entered in favor of certain employees who worked at Walmart and Sam’s Club Stores. If you worked as an hourly employee at a Walmart or Sam’s Club store between Mar. 19, 1998 and May 1, 2006, you may be entitled to payment from this class action lawsuit.

The plaintiffs filed the Walmart class action lawsuit seeking redress for missed meal and rest breaks and for off-the-clock work that employees allegedly performed when employed by Walmart.

They asserted claims for breach of contract, violations of the Pennsylvania Minimum Wage Act, violations of the Pennsylvania Wage Payment and Collection Act, restitution and unjust enrichment.

This Walmart lawsuit was certified as a class action lawsuit on Dec. 27, 2005. Approximately 187,000 current and former Pennsylvania employees may be entitled to benefits from the Walmart class action lawsuit.

On Oct. 13, 2006, a jury returned a $78.5 million verdict in favor of Walmart Stores Inc. employees who were forced to miss rest breaks and work off the clock in Pennsylvania between Mar. 19, 1998 and May 1, 2006.

A judge awarded Class Members an additional $62.3 million in statutory damages. Approximately 124,500 Class Members are entitled to statutory damages.

Walmart appealed the verdict and the appeal reached the U.S. Supreme Court. However, the high court refused to hear the case earlier this year. Therefore, the judgment stands.

Who’s Eligible

Class Members include hourly employees who were employed by Walmart or Sam’s Club stores in Pennsylvania between Mar. 19, 1998 and May 1, 2006.

According to the settlement website, payments are expected to be made by the end of 2016.

    I have been Getting the run around from them too
    Stated they didn’t have all my details when they did. I knew about this dating back to when first filed. I am so over it they don’t know when the next round of checks are going to be mailed out

    Got a letter in 2009 in Missouri ( lived in Missouri at time ) stating if I wanted to still be a part of law suit I marked yes then I moved out of state I put a change of address in and still have not heard anything can some one tell me where to go from here sounds like only pen state people are getting checks

    Yep, same. They’ll reissue my check. Another damn wait, 30-60 days. This is absolute bull, screwing us over, is it time we all get a lawyer and charge interest and pain and suffering? I’m ticked!

      They didn’t send the checks to begin with they sent out certain checks she said sje mailed my check back out the 24th its the 31st no check she said wait til 2nd week of september but im only a half hour away from where they send checks they are full of shit the supervisor was very ignorant

        They are nothing but full of excuses, nobody knows what the hell they’re doing there, every person I talk to has a different story about why I haven’t received my check. Something needs done.

      To hell with it they can have the money im over this they told me 2 different times my check was in mail never received it now they saying they will reissue in 30 to 60 days im over this keep the damn check then i ask for a supervisor and they wont allow me to speak to anyone

    I called today and was just told the same thing. The gentleman that answered said it was postmarked for the 8th. He read me my address but said they forgot to put the apt. Number on it so he put in for a reissue of another check. What is really going on.

      So i just called its gonna be another 60 days before they reissue out checks the full of crap

      They are screwing us over, that’s what they’re doing. They probably ran out of money and gotta come up with excuses. First they told me I was getting near 1800, back in February when I called and I should get it end of May. Then end of may came, I was told they needed to go back to court and get funds re-released and by the end of summer I’ll get it. Then July I was told for sure that checks are getting mailed out and that I was only getting 580.00…???
      And I questioned why the price difference and was told that the first amount was a computer glitch and was told the wrong amt.
      I have had it with these people’s lies! Something needs done!!
