Wal-Mart Stores Inc. has reached a class action lawsuit settlement over claims that it sold Miley Cyrus-branded jewelry manufactured by BCBG Max Azria Group Inc. that contained high levels of a dangerous chemical. If you purchased Miley Cyrus jewelry from a Wal-Mart retail store after July 1, 2005, you may be eligible for a refund from the class action settlement.
The Wal-Mart Miley Cyrus jewelry settlement will resolve a class action lawsuit (Canamore v. Wal-Mart Stores Inc.) that alleges the Miley Cyrus-branded jewelry that contained cadmium, which the plaintiffs allege posed a danger to its wearers. Wal-Mart pulled the allegedly toxic jewelry from store shelves in 2010.
Wal-Mart denies any wrongdoing but has agreed to provide refunds to consumers under a class action lawsuit settlement that was preliminarily approved on Nov. 5, 2013.
To participate in the Wal-Mart Miley Cyrus-branded jewelry class action settlement, the Settlement Administrator must receive your Claim Form and supporting documents by March 12, 2014.
Who’s Eligible
Anyone who purchased Miley Cyrus-branded jewelry from a Wal-Mart retail store in the United States after July 1, 2005.
Potential Award
Cash refund of between $2.00 and $6.00 per item purchased.
Proof of Purchase
To receive a refund from the Wal-Mart Miley Cyrus-branded jewelry class action settlement, you must submit a claim form and proof of purchase by March 12, 2014 to the following address:

Under the terms of the class action settlement, Class Members can submit claims for a cash refund of the purchase price of the Miley Cyrus-branded jewelry by one of three methods:
- Returning the jewelry in person or by mail to the Claims Administrator for a refund of the purchase price.
- Providing an original receipt from a U.S. Wal-Mart retail store itemizing the purchase of the jewelry.
- Providing proof of purchase of the Miley Cyrus-branded jewelry from a U.S. Wal-Mart retail store by other means. Claim submitted by this method will require certification.

This included a sworn statement that they purchased the Miley Cyrus Jewelry, documentation verifying their name and address, and a completed IRS Form W-9 for tax purposes.

In accordance with the Claims Administrator’s duties in administering the Settlement, we are authorized to request further documentation to substantiate your claim(s). In order to validate your claim(s), you must submit the following requested information by email to CanamoreSettlement@GCGINC.com or fax to (206) 876-5201 so that it is received no later than April 4, 2014:
1. Documentation that verifies your name and address (as listed in the claim you submitted) e.g. driver’s license, telephone bill, or utility bill.
2. A sworn statement stating:
a. I purchased Miley Cyrus-branded jewelry from Wal-Mart Stores, Inc.; and
b. The Product(s) for which my claim is being submitted have not previously been returned for a refund or other consideration to a Wal-Mart store; and
c. The Product(s) for which the claim is being submitted are not within my custody or my control, and
d. I do not have a receipt relating to the purchase of the Product(s) for which the claim is being submitted; and
e. You write “under penalty of perjury I state the foregoing is true and correct” and then sign and print your legal name.
3. Provide a completed IRS Form W-9 for tax purposes, which can be located at: http://www.irs.gov/pub/irs-pdf/fw9.pdf
Upon receipt of the above information, your claim will be further evaluated. If no response or an incomplete response is received by April 4, 2014, your claim will be denied without further communication from the Claims Administrator.
