Home security company Vivint Inc. has reached a $6 million class action lawsuit settlement over allegations its telemarketers violated the federal Telephone Consumer Protection Act while promoting Vivint home alarms and services. If approved, Class Members could claim up to $500 from the Vivint class action settlement.
The Vivint TCPA settlement will resolve allegations that telemarketers violated federal law by utilizing prerecorded messages and autodialing equipment to contact persons and entities in the United States since 2008. The Vivint class action lawsuit also accuses the company of placing calls to consumers who had their telephone number registered on the National Do Not Call Registry and on Vivint’s internal Do Not Call list.
Vivint denies the allegations but agreed to a $6 million class action settlement to resolve the litigation and avoid the expense of going to trial.
A federal judge preliminarily approved the Vivint TCPA class action settlement on June 9. A Final Fairness Hearing is scheduled for Aug. 25.
Who’s Eligible
Class Members of the Vivint TCPA settlement include all U.S. individuals and entities that received one or more “Covered Calls” on behalf of Vivint Inc. on or after Sept. 17, 2008. “Covered Calls” means either:
- a call utilizing an artificial or prerecorded message;
- a call made through the use of automated dialing equipment;
- a call made to a telephone number that was registered on the National Do Not Call Registery or was on Vivint’s internal “Do Not Call” list.
The phone call(s) must have related to Vivint products or services or were made by anyone seeking to generate leads related to Vivint.
Potential Award
Up to $500. This amount may be reduced pro rata based on the number of eligible claims filed.
Proof of Purchase
You must provide the telephone number where you received the call and approximate date of the call.

Krissy I hope u not lying cause my email states:::::We are currently waiting on a court order approving the distribution and it is expected soon. We are not able to distribute the settlement fund until we receive that order. There is not a date set at this time for distribution.

Finally got an email back…. If you were parroted, The checks have already been sent out. Sent on the 25th Of November.

Well everyone just be patience if the checks are for us to get we will get them if not we will have to just [ Pray that the people do what’s right and start sending the checks out.
Vivant settlement checks were due out 60 days after the effective date of the settlement. The effective date was August 2014
I think we all need to call and put fire up there &E#$&……Let’s get it started and we will start seeing checks
Has anyone got any updates?
I received & mailed back the the official card, but as of 11/12/2014 haven’t received settlement payment or any update information. the final hearing was 8/2014 and settlement checks are to be payed by no later than end of Nov 2014?
