Parties to two Visionworks class action lawsuits alleging a deceptive “Buy One, Get One Free” offer have reached a settlement agreement resolving both cases.
Consumers who made a qualifying “Buy One, Get One Free” purchase from Visionworks stores in Ohio and Illinois may be entitled to a settlement payment.
The plaintiffs claim that as part of its BOGO offer, eyeglass retailer Visionworks inflated the price of the first pair of glasses to partly cover the cost of the second and purportedly “free” pair of glasses.
The second pair was therefore not actually “free” as advertised, the plaintiffs claim. They allege Visionworks’ “Buy One, Get One Free” promotion violates the consumer protection laws of Ohio and Illinois.
The first Visionworks class action lawsuit was filed in June 2014 in Ohio state court, then removed to federal court. The original plaintiff voluntarily withdrew from that action in September 2016 and was replaced by current plaintiff Karen Poteat.
The second Visionworks class action lawsuit was filed in June 2016 by plaintiff Cheryl Lenart, in a federal court in Illinois. In September 2016, Lenart’s action was transferred to the Northern District of Ohio, to be handled together with Poteat’s action.
The parties agreed to this Visionworks settlement in January 2017. Under terms of the settlement, qualifying claimants may be entitled to cash payments from a settlement fund totaling $4.2 million.
Visionworks continues to deny the plaintiffs’ allegations, maintaining that it acted lawfully at all relevant times.
The objection or exclusion deadline for the Visionworks settlement is April 14, 2017.

They haven’t even had the final hearing yet.
Please, why is Kentucky not included in this lawsuit against Vision Works? After I got my detail of benefits from my insurance company, I found that I was overcharged $100, over what they even billed my insurance for. And when I went to pick up my glasses, I asked why I wasn’t given a free pair. I was told “you wouldn’t want them anyway, they’re a cheap pair.
Unfortunately, some class action lawsuits are very specific to certain state consumer protection laws. You can contact class counsel with any questions about the case. Counsel is listed in the article and can be Googled for contact information.
I live in Georgia. The VisionWorks in my area of Douglasville, Ga. did the exact same thing. I walked out paying th outrageous amount of $519.41. They never billed to my insurance and gave me the run around about the entire issue! I will never use them again!
Connecticut Vision Works pulled the same nonsense for the BOGO on Monday May 1st! Why can’t you add other states who get ripped off by this deal?
I live smack dab in the middle of those states-Indiana, and it was 2003 or 2004 that I bought a BOGO set of glasses from them. They were over $700, the “free” pair was over $400 so I felt like it was still a deal. It was first 2 pair of glasses I bought with my own money (young and naive). After being told by others I overpaid, I looked in to it and the first pair should have been around $350-400 and the second closer to $200. I never went back and discouraged people from going there. I actually might (but likely don’t) still have the receipt.
My name is Cheryl Lenart and I am the Plaintiff in the Illinois case. It is my understanding it was filed in the a federal court in Illinois. Please contact Drew Lagondo, above counsel in my case, to see if you qualify in filling out the form above. Hope this helps.
Please include Pennsylvania!!!!!!!
Never buying eyeglasses from them again!
I have purchased this BOGO from them four years in a row from 2004 on up. Using my flex spending with my job and my own personal money. It was in North Carolina but I am confused as to why these two states are the only ones in on this class action. Could another suit be filed on them for North Carolina? They are doing the exact same thing!
I second that. . I am located in TX.
I purchased eyeglasses using the BOGO promo from Vision-works in Louisiana 18 mo ago.. Not only was the final price astounding, but after being told my insurance was acceptable, at the end of the transaction I couldn’t use my insurance. I won’t ever do business with them again.
I actually purchased glasses from them TWICE, like some idiot! The first time I thought that it was just me and the second time I decided that I would NEVER buy another pair of glasses from them again. They should be ashamed of themselves.
But here is my thought……….if the same practices and procedures apply IN ALL OF THEIR STORES, why not include EVERYONE that purchased glasses from them? By law, they are supposed to turn over the client information when subpoenaed.
