Venture Data LLC and Public Opinion Strategies LLC have agreed to pay $2.1 million to settle a class action lawsuit alleging Venture Data made calls on behalf of Public Opinion using an automatic telephone dialing system to place calls to cell phones without obtaining the recipients’ prior consent, in violation of the Telephone Consumer Protection Act.
If Venture Data placed a call to your cell phone on June 11, Aug. 19, or Sept. 9, 2014 as part of a Public Opinion Strategies survey, you may be entitled to payment from the TCPA class action settlement.
According to the Venture Data class action lawsuit, the defendants violated the TCPA by making calls to cell phones using an automatic telephone dialing system without first getting permission from the recipients to receive such calls.
The Telephone Consumer Protection Act was enacted by Congress in 1991 to regulate the telemarketing industry. The TCPA prohibits telemarketing using unsolicited automated or pre-recorded telephone calls, and prohibits telemarketing calls from being made to phone numbers listed on the national Do Not Call Registry unless the caller has the recipient’s signed, written consent, the Venture Data class action lawsuit says.
Plaintiff Diana Mey alleges Venture Data placed a computer-dialed phone call to her cell phone without her prior express consent in violation of the TCPA. Her cell phone number was registered on the national Do Not Call Registry, the TCPA class action lawsuit alleges.
The Venture Data class action lawsuit sought an award of statutory damages of $500 per each negligent violation of the TCPA and $1,500 for each knowing violation of the TCPA.
Venture Data and Public Opinion deny all allegations of wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.
Class Members who would like to opt out of or object to the Venture Data TCPA settlement must do so no later than June 11, 2018.
Who’s Eligible
If Venture Data placed a call to your cell phone on June 11, Aug. 19 or Sept. 9, 2014 using the Pro-T-S or CFMC dialer, and the call was part of a Public Opinion Strategies survey, you qualify as a Class Member of the Venture Data TCPA settlement.

Class Members are asked to provide Claimant Identification and the telephone number at which they received a qualifying call from Venture Data.

There is no way that I can prove that they called me at least once a day, even though its common knowledge that these people are common unsolicited telemarketers. The numbers that come up are so weird and every time they call I get another weird number. So can you please tell me how I can get proof that they called me when they don’t leave a message and I have to distinguish their calls with the dozens of other telemarketers that call me.

This one is an impossible settlement. I get survey calls all the time and have no idea what kind of dialer they are using no who they are. VERY poorly written settlement. I would bet that they have a list of numbers they called and just don’t want to use it unless they are going to dispute a claim.

What does it mean by claimant identification
Really? What does that have to do with your phone number that was called?
If you received a notification letter/postcard in the mail concerning this settlement, then it would have included a Claimant ID # that is specifically assigned to you. If you did not receive a mailed notification but believe you are eligible to join the settlement, then you would leave the Claimant ID box blank.
I tried leaving the Claimant ID box blank but the form won’t let me continue. It acts as if it’s a required field. :(
