A settlement has been reached in a class action lawsuit filed over a breach of ticket seller Vendini Inc.’s servers and the disclosure of customer data, including names, mailing addresses, email addresses, phone numbers and credit card information. If your personal identification information resided on Vendini’s computer network services on or before April 25, 2013, you may be entitled to receive compensation for unauthorized access or use of your information.
Vendini is a fully hosted online ticketing system used for sports events, concerts, art shows and festivals. The ticketing services company has an unknown number of clients. The following list is representative of some of the popular programs that use Vendini’s services:
- College Athletic Programs
- Speedways
- PGA Golf Tournaments
- Performing Arts Centers
- Community Theaters
- Festival Promoters
- Concert Promoters
- Casino Commissions
Under the terms of the proposed data breach class action settlement, Vendini has agreed to pay a total of $3 million to create a settlement fund. Vendini denies the allegations but agreed to settle the data breach class action lawsuit to avoid the risk and uncertainty of ongoing litigation.

Who’s Eligible
Class Members of the Vendini data breach settlement include anyone in the United States whose personal identification information resided on Vendini’s computer network servers on or before April 25, 2013. Personal identification information includes names, mailing addresses, email addresses, phone numbers, credit card numbers, expiration dates, and/or other identifying information.
Potential Award
Up to $3,000. Under the terms of the Vendini class action settlement, Class Members who submit a timely and valid Claim Form will be eligible to receive compensation for either or both Unreimbursed Identity Theft Losses (of up to $3,000) or compensation for Unreimbursed Expenses (of up to $1,000).
Unreimbursed Identity Theft Losses include any actual losses resulting from identity theft, such as the use of a Class Member’s name, mailing address, email address, phone number, credit card number and/or any other identifying information arising from the data breach to commit fraud or other crimes without the Class Member’s knowledge or consent.
Unreimbursed Expenses include the following out-of-pocket expenses incurred through the end of the Claims Period that can be attributed to the data breach:
- The cost of obtaining, prior to June 27, 2014, credit monitoring or identity theft insurance (up to a total maximum of $250)
- The cost of telephone calls, fax transmissions and postage relating to identity theft or potential identity theft with banks, credit card companies, credit reporting agencies or creditors (up to $60)
- The cost of placing a freeze on your credit report
- The cost of changing your phone number (up to $200)
- The cost of ordering or obtaining replacement credit or debit cards (up to $20)
- Late fees proximately caused by losses or expenses incurred as a result of identity theft (up to $200)
- Overdraft fees proximately caused by losses or expenses incurred as the result of identity theft (up to $200)
Proof of Purchase
To receive compensation from the Vendini data breach settlement, Class Members must provide information and documentation supporting their losses. The amount of money Class Members actually receive may be increased or decreased based on the number of claimants and the value of their claims.
Examples of supporting documents include:
- Receipts for expenses incurred
- Credit monitoring or insurance policies
- Bank statements showing overdrafts
- Creditor statements showing late fees
- Police reports or reports from another government agency concerning the identity theft
- Letters or affidavits from a bank regarding fraudulent charges
- Documents showing a creditor’s refusal to waive or excuse charges
