URS class action settlement

United Recovery Systems LP has agreed to settle a class action lawsuit that accuses it of violating the Fair Debt Collections Practices Act (FDCPA). If you received at least one letter from URS between Dec. 4, 2013 and May 22, 2015, you may be entitled to a cash payment from the FDCPA class action settlement.

Plaintiff Susan Ebner filed the FDCPA class action lawsuit, which alleges that United Recovery Systems engaged in prohibited debt collection practices by mailing letters that contained information in addition to the recipient’s name and address, which was visible through the envelope’s glassine window.

This conduct allegedly violates the laws of Pennsylvania, New Jersey, Delaware and the U.S. Virgin Islands.

Ebner claims that she received a letter from United Recovery Systems in which a “URS No.” or a QR box or barcode with that information was visible.

According to the URS class action lawsuit, exposing this information in a debt collection mailing constitutes a violation of the FDCPA.

United Recovery Systems denies the allegations and asserts that there was no exposure of information that could result in the compromise of any Class Member’s identity, Social Security number and/or financial data visible through the mailing envelope.

However, URS has agreed to settle the FDCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who wish to opt out of the United Recovery Systems settlement must do so no later than July 18, 2016.

If you wish to object to the URS class action settlement, you must submit your objection and any supporting documents no later than Aug. 16, 2016.

Who’s Eligible

Class Members of the United Recovery Systems FDCPA settlement include anyone located in Pennsylvania, New Jersey, Delaware or the U.S. Virgin Islands (according to their last known address in URS’s records) who received one or more letters from URS that displayed identifying information other than the recipient’s name and address through the envelope’s glassine window between Dec. 4, 2013 and May 22, 2015.

Potential Award

Up to $1,000. The amount of compensation each Class Member will receive depends on the total number of valid and timely claims that are filed.

The minimum payment a Class Member may receive is approximately $2.68 and the maximum is $1,000.

    I called last week and the receptionist stated that checks started mailing on 11/14/16. She also said that we could look to receive $33. I was a little bummed cause Ms. Ebner received $3500 plus her statutory award of $1000 as per the settlement.?

      Trinia,

      That is unbelievable. I can’t believe it will only be $33. That’s insane considering the amount they sued for and the amount that they received. I read the all documents on record that were filed w/court and they rec’d quite a bit of loot for this litigation claim.

        That’s what I thought. I saw that Ms. Ebner’s statutory award was $1000 and assumed that was what all members would have received. I called the law office in PA and the receptionist gave me the $33 figure. Also, there is another class action against URS that is also in the works for settling. Hopefully, she got the two mixed up.

          I wonder what the other URS class action case is about and do we qualify for that one? Just wondering…..

          I hope you are right and the receptionist did get the two mixed up. I honestly thought that we’d receive anywhere between $500 up to $1,000 because in the litigation docs it stated that we’d receive well under $1,000. But, I was thinking possibly $500-$700 since Ms. Ebner’s statutory award was $1,000 (but she got that other award of $3,500). But, a whopping $33 is pathetic/ridiculous and useless. I think we deserve a whole lot more than that.

    I returned the claim that Ebner had sent me via snail mail. I opted ‘in’. To date, November 17th 2016, I have not received any check(s) in the mail from this lawsuit. Does anyone have any information, on how much each person who was involved, who had opted in, will actually receive? Thanks for any help. Alison

      Unfortunately, the settlement agreement does not state how quickly claims will be paid. Hopefully it will be sooner than later. But, it can take a settlement administrator several months to review and process claims. As of August 25, 2016, the settlement administrator had received almost 18,000 claim submissions. Please keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn that checks are in the mail!

    I just received 3 checks from PayDayLoanRedress.com $13.00, $500.00 & $1050.00 ,they said they would be from $21.00 to $35.00 ,but not many people signed up .it was for online payday loans
