Under a United Propane Gas class action settlement, current and former customers who were subject to propane gas rationing in 2013 and 2014 may be entitled to a $75 or $150 in cash or credit.
The $665,000 United Propane Gas class action settlement puts to rest allegations that the company improperly rationed the distribution of gas to Kentucky residents during the winter of 2013 and 2014.
The plaintiffs alleges that United Propane Gas agreed to sell fuel for heating purposes at a set rate during the winter months under a “PreBuy KeepFull” gas supply agreement.
The gas during the winter of 2013-2014 was stored in Texas, however, leading to shortages because of the severe cold experienced in the United Propane Gas service area in Kentucky at that time.
The plaintiffs alleged that they and other customers were told that United Propane Gas would have “plenty” of fuel for them during that time, but instead were faced with rationing.
The company admits no wrongdoing under the terms of the United Propane Gas class action settlement; however, they have agreed to pay former customers of the “PreBuy KeepFull” gas supply agreement who were subject to rationing during the winter of 2013 to 2014.
There are exceptions for those who received payment through another case, Andy Beshear v. United Propane Gas Inc., et al., and for those who received 50 gallons of gas between Jan. 20, 2014 and Jan. 27, 2014, as well as for customers who revived all of their pre-purchased gas by Jan. 27, 2014.
Additionally, those who who either purchased the prebuy propane before Jan. 27, 2014 and received the propane between Jan. 27 to Feb. 13, 2014 are not included in the settlement.
Further, United Propane Gas customers who were charged the market, rather than prebuy rate for propane ordered under the agreement, but received a credit on their account before June 15, 2014 are not included as Class Members.
