Umpqua Bank job applicants have secured a $325,000 class action settlement over allegations that the financial company obtained consumer reports about them without proper disclosure and notification.
The lead plaintiff alleged that she applied for a job with Umpqua Bank in 2014. According to her class action lawsuit, Umpqua Bank had offered her a job, but also required to her to sign a disclosure and authorization form allowing the bank to pull a background report.
The bank allegedly did this with other job applicants at the time, but it failed to provide a “clear and conspicuous” disclosure in a standalone document as required under federal law.
The plaintiff claims that she and other Umpqua Bank job applicants were not given proper warning that their credit reports and/or background checks would be accessed by the bank.
Under the terms of the Umpqua Bank job applicant background check class action settlement, those who applied for a job at the bank between April 2, 2010 and Sept. 21, 2015 may be able to claim a part of the $325,000 settlement fund.
Class Members should be notified by email or mail about the settlement.
Umpqua has also agreed to pay a $2,500 plaintiff award and attorney fees, though the bank does not admit any wrong doing under the terms of the class action settlement.
Class Members have until Jan. 10, 2019 to exclude themselves from the Umpqua Bank job applicant background check class action settlement. The final hearing is scheduled for Feb. 21, 2019.
Who’s Eligible
You are a Class Members if “you applied for employment with, or are/were employed by, Umpqua Bank, (ii) you completed a disclosure and authorization form during the Class Period, defined as April 2, 2010 – September 21, 2015, and (iii) Umpqua obtained, during the Class Period, a consumer report about you for employment purposes.”

Class Members will automatically be notified, but if you have changed your address since applying with Umpqua Bank you can contract the Settlement Administrator.
