UberX-Driver-Lawsuit

A $7.5 million settlement has been reached in a class action lawsuit over allegations Uber Technologies Inc. and Rasier Inc. violated the Fair Credit Reporting Act when obtaining consumer background check reports for prospective Uber drivers.

If you used or sought to use the Uber app as an Uber driver, you may be entitled to compensation from the Uber FCRA class action settlement.

According to the Uber driver background check class action lawsuit, Uber and Rasier failed to provide proper notice about their intent to procure background check reports, to obtain proper authorization before procuring background check reports and to provide required copies of the reports before taking adverse employment action against Uber drivers in violation of the FCRA.

Plaintiff Abdul Kadir Mohamed filed the first Uber FCRA class action lawsuit on Nov. 24, 2014. A second Uber class action lawsuit was filed two days later. Uber sought to compel arbitration in both FCRA class action lawsuits, but the court denied both requests. A third Uber class action lawsuit was filed in June 2015, and the three cases were consolidated on Oct. 1, 2015. If approved, this proposed FCRA settlement will resolve all three Uber class action lawsuits.

The plaintiffs allege Uber took adverse employment against them based on information contained in background check reports. However, Uber failed to notify the plaintiffs about their intent to procure the background check, failed to obtain prior authorization from them before obtaining the background check information, and failed to provide required copies of the reports or a summary of their rights under FCRA before taking adverse employment action against them, according to the Uber class action lawsuit.

The defendants deny the allegations and maintain FCRA laws do not apply to people who work as “independent transportation providers” for Uber. However, they have agreed to settle the Uber background check class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who would like to opt out of or object to the Uber FCRA settlement must do so no later than Dec. 14, 2017.

UPDATE: On Jan. 25, 2018, a group of Uber drivers urged a federal judge to grant final approval to a $7.5 million settlement agreement in a class action accusing the ride share company of violating the Fair Credit and Reporting Act, despite objections.

Who’s Eligible

You are a Class Member of the Uber driver FCRA settlement if you were subject to a background check requested by Uber and Rasier before Jan. 3, 2015 in connection with your use, or sought use of, the Uber App as an Uber driver.

Potential Award

$27 to $62 (estimated).

The actual amount each claimant will receive from the Uber driver FCRA class action settlement depends on whether the Class Member accepted an arbitration provision, and the total number of timely and valid claims submitted.

Proof of Purchase

N/A. Class Members must declare under the penalty of perjury that they were subject to a background check and/or consumer report requested by Uber before Jan. 3, 2015, and that they were not designated as an employee of Uber at the time.

    I received a call from the Settlement Administrator Angion Group today after leaving a message. There was an appeal filed. I suggested they update their website that an appeal was filed & was told that was just noticed & will be shortly. Disbursement will be awhile until appeal resolved. Just a FYI ..

    I’ve been Uber driver over 2 years and they got me on the background check it’s been over a week now I’ve been I’ve been calling and asking about my inner trying to get back on online I just got the apartment now I’m subject to get put out because they had me on hold for over a week I would like to see if I can get conversated for the money I lost I work for FedEx and my background was good I have over 5000 trips in 2 years and over 2,000 five stars I make close to $200 day know who is going to compensate me for them days that I miss I like I said it’s been over that I have not been online they did not give me no notification if it’s going to take me offline and in their agreement they don’t State how long it takes for you to get back online

    My name is Mac. I was exepted to be an uber driver team 6/0/17 or so, procrastinated on getting my uberx unprovable car and copleting the process till 02/0/18 or so but got on the road and did a 9 hour shift starting at 7pm. The next day my uber account was unusable and said they were undergoing another background check. It has not passed due to old events from a long time ago.
    Is this legal? If so how is this legal? I can’t be the only one that invested 10,000 into a car to have everything i have done turn intodust.

        Per Uber FCRA Litigation Settlement Administrator, “An appeal to the Court’s Order Granting Final Approval has been filed. Distribution of funds cannot take place until this appeal is resolved. There is no way to know when the appeal will be resolved, so please be patient.”

    Fare Geek,rob me of $100.00 and hundreds of phone calls, and in the end sent me a bogus check from Bank of America who would not cover it or verify the fare geek account.
