TicketsOnSale.com agreed to a $4.1 million class action lawsuit settlement to resolve claims it failed to refund ticket sales for canceled events.

The settlement benefits consumers who purchased a ticket through TicketsOnSale.com and/or OnlineCityTickets.com before Aug. 17, 2022, to an event scheduled from March 23, 2017, to Aug. 17, 2022, that was canceled, postponed or rescheduled to a date that has not yet occurred.

TicketsOnSale.com is a ticket resale website that allows third-party resellers to list tickets for concerts, sporting events and other events. OnlineCityTickets.com is a similar ticket resale website. A 2022 class action lawsuit claimed that the two ticket websites violated their terms of use by failing to provide refunds for canceled or rescheduled events. 

The defendants allegedly promise a “100% Buyer Guarantee” for all tickets purchased through their websites. However, despite these promises, the ticket websites refuse to issue refunds for canceled events, the plaintiffs contend. Instead, the defendants allegedly issue credits towards the purchase of future tickets on their websites.

TicketsOnSale hasn’t admitted any wrongdoing but agreed to pay $4.1 million to resolve the allegations in the class action lawsuit.

Under the terms of the TicketsOnSale refund settlement, class members can either use the credits they were awarded by the ticket website or receive a cash payment. Credits issued by TicketsOnSale.com are equal to 120% of the ticket’s original purchase price. Class members who purchased tickets for canceled events should have already received credits towards the purchase of tickets on TicketsOnSale.com. The settlement extends the expiration date of active credits through Jan. 31, 2023. 

Class members can opt to receive a cash payment instead of these credits. The payments from the settlement will be equal to the price paid for tickets purchased, including fees and delivery charges, less any amount paid using gift cards or credits. California residents are eligible only to receive a cash payment from the settlement. Payments may be reduced on a pro rata basis, resulting in smaller cash payments. In this situation, class members will retain a portion of their existing credits to compensate for lower payments.

The deadline for exclusion and objection is Dec. 1, 2022. 

The final approval hearing for the TicketsOnSale refund settlement is scheduled for Jan. 19, 2023.

In order to receive settlement payments for canceled events, class members must submit a valid claim form by Jan. 17, 2023. No action is required for class members who wish to keep their ticket credits instead of receiving a cash payment.
