Target Flushable Wipes Class Action Settlement

Target Corp. and Nice-Pak Products Inc. have agreed to settle a class action lawsuit alleging certain Up & Up flushable toddler wipes were not actually flushable.

If you purchased Up & Up flushable toddler wipes between April 18, 2010 and Oct. 31, 2014, you may be entitled to benefits from the Target flushable wipes class action settlement.

Plaintiff Christopher Meta filed the Target class action lawsuit against Target and Nice-Pak in July 2014, claiming Target-brand Up & Up “flushable” wipes manufactured by Nice-Pak were not “flushable” or “sewer and septic safe” as advertised.

“Rather, they end up clogging consumers’ plumbing and septic systems, potentially resulting in hundreds, even thousands of dollars in damage,” the Target flushable wipes class action lawsuit alleges.

“Indeed, this is precisely what happened to Mr. Meta as a result of his use of the Up & Up Wipes. Simply put, the Up & Up wipes are defective because they are not ‘flushable.’”

According to the Target flushable wipes class action lawsuit, Meta began purchasing Up & Up flushable wipes in 2011. He says he used them primarily for potty training his child and disposed of the supposedly flushable wipes by flushing them down the toilet as directed on the package.

In 2013, Meta says he began noticing plumbing issues in his home, such as the bathtub not draining and the toilet not flushing properly. He hired a septic pumping company to find out the cause of the problem. The company reportedly found that the Up & Up wipes did not completely break apart after flushing and had “caked together” in the plumbing and septic system.

The Target flushable wipes class action lawsuit says that Meta paid $210 for the labor and service, but could be faced with a cost of as much as $20,000 if the septic system is found to be permanently damaged.

Meta claims that he would not have purchased the Target-brand Up & Up flushable wipes if he had known they were not actually septic safe and flushable.

The Target flushable wipes class action lawsuit was certified in 2016.

Target and Nice-Pak deny the allegations but agreed to settle the flushable wipes class action lawsuit to avoid the risk and expense of further litigation.

Who’s Eligible

Class Members of the Target flushable wipes settlement include U.S. residents who purchased Up & Up flushable toddler wipes from April 28, 2010 through Oct. 31, 2014.

Potential Award

A Target gift card or a Target coupon for free Up & Up products.

Class Members may either opt to receive a Target gift card valued at $1.35 per eligible product purchased or a coupon for a unit of current Nice-Pak Up & Up wipes (double 48-count package or equivalent, depending on the product).

NOTE: Class Members who do not submit proof or purchase may only submit claims for up to 20 units. There is no cap imposed on the Target gift card amount the claimant is entitled to recover for Class Members who submit proof of purchase.

Proof of Purchase

None required. However, Class Members who do not submit proof of purchase will have their claims capped at a maximum of 20 units.
