Hi-Tech Pharmacal Co. Inc. has agreed to settle a class action lawsuit alleging that it misrepresented the efficacy of a group of over-the counter drugs. If you purchased Sinus Buster products between March 7, 2012 and Feb. 20, 2014, you could be eligible for a cash payment from the Sinus Buster class action settlement.
Who’s Eligible
Class Members of the Sinus Buster class action settlement include all persons in the United States who purchased the following Sinus Buster products between March 7, 2012 and Feb. 20, 2014:

- Sinus Buster Mild
- Sinus Buster Anti-Cold Formula
- Cold Buster
- Allergy Buster
- Sinus Buster Allergy Formula
- Headache Buster
- Sinus Buster Headache Formula
Potential Award
$5Â and up.
Proof of Purchase
The Sinus Buster settlement will provide refunds of $5 per affected product, up to a maximum of two products, to Class Members who do not submit a proof of purchase. Class Members who submit proofs of purchase with their Claim Forms will be eligible to receive a full monetary refund of the actual purchase price of the affected products purchased.

Case Summary
Sinus Buster products are a line of capsaicin-based drugs that are marketed and sold online and in retail stores for between $10 and $15 per bottle. According to the class action lawsuit, Hi-Tech claims capsaicin has the ability to treat sinus congestion and related cold and allergy symptoms. The Sinus Buster products are sold as over-the-counter homeopathic drugs, and have therefore not been evaluated or approved by the U.S. Food & Drug Administration (FDA). According to the class action lawsuit, Hi-Tech falsely represented that Sinus Buster products were effective for their advertised purpose, homeopathic, FDA-approved, and proven effective.
The Sinus Buster class action lawsuit alleges Hi-Tech misrepresented the efficacy of its Sinus Buster products in violation of consumer protection and warranty laws. The plaintiffs claim that they would not have purchased or paid as much for the products if the products had been labeled accurately. Hi-Tech denies the allegations but has agreed to the class action settlement to avoid the expense and uncertainty of ongoing litigation.

I took headache buster, then sinus buster for horrible cluster headaches. This was the only thing that would work. It was a godsend. I had gone to neurologists and everything they tried didn’t touch the cluster headaches, once I discovered headache buster I had relief instantly Two squirts and the headache would leave. So sad this isn’t available any more

Totally agree, it works great and still have a few bottles myself we use. I was getting low on what I had and went online to find more and ran into this BS!!! I purchased it back at that date but I know it worked GREAT!!!!

This was THE BEST DAMN product out there. It wasn’t habit forming like the rest, it helped with migraines too! It even helped with my Trigeminal Neuralgia.

Sinus Buster is the best sinus relif med I’ve ever used. I am saddened by those who felt the need to sue. It did everything it said and so much more. I l find myself still checking shelve for it when I’m in the store.
Allergy Buster works great for me. I thought I could get some on Amazon. I am so disappointed. The main ingredient is capsaicin.

That right, I used it all the time until it wasn’t available anymore around my neighborhood, it worked really good for me and was the only medication that really provided relief, I introduced my Mom to it and she also liked it and used it all the time because it worked. Sometimes people just do these class action lawsuits for the money.
I don’t want a stupid check. I want Sinus Buster back. The whole reason the FDA doesn’t approve homeopathic drugs is because they work different for different people. I want the selfish person who refused to just search for his/her own best product to acknowledge this and let us get our product back.
