A $42 million judgment against Safeway is now being distributed to qualifying Class Members who were allegedly overcharged for online grocery delivery service.
Delivery customers of Safeway may qualify for reimbursement if they registered for Safeway.com delivery service before November 2011 and placed an order between April 2010 and December 2014.
This Safeway class action lawsuit began in June 2011. Plaintiff Michael Rodman alleged defendant Safeway Inc. charged more than just its stated delivery fee for the online grocery delivery service it offered in select metropolitan areas.
According to Rodman, Safeway charged around 10 percent more than its in-store price for each grocery item sold and delivered through this service. He claims Safeway levied this upcharge in violation of the stated terms of its delivery service, which assured customers they would pay the same price for groceries as they would pay when shopping in person.
The court certified Rodman’s proposed Class in March 2014. In December 2014, the court granted Rodman’s motion for partial summary judgment, concluding that Safeway breached its contract with delivery customers.
The court entered judgment in November 2015 for damages and prejudgment interest totaling nearly $42 million. Safeway appealed the judgment, but it was upheld in August 2017 by the Ninth Circuit Court of Appeals. The judgment is now final.
The judgment funds are now being distributed by a third-party judgment administrator, similar to how funds are distributed from a class action settlement. The judgment administrator will mail checks to known Class Members at the address reflected in existing records. Class Members do not need to submit a claim to receive payment.
To make sure they receive their check, Class Members are encouraged to check the class membership notice they received to confirm that their mailing address and the name of the check payee are correct. Class Members can update this information with the judgment administrator.
Class Counsel has requested a fraction of the funds to cover attorneys’ fees, court costs, and a $10,000 service award for Rodman. Class Members may object to class counsel’s request for attorneys’ fees and costs, or to Rodman’s request for a service award.
The deadline for filing objections is March 2, 2018, and the court will hold a hearing on those issues on March 29, 2018.
Who’s Eligible
Safeway delivery customers may qualify as Class Members if they registered to purchase groceries through Safeway.com any time before Nov. 15, 2011 and, between April 2010 and Dec. 21, 2014, made one or more purchases subject to the price markup implemented on or about April 12, 2010.

Varies.
The amount of each Class Member’s payment will be determined by the amount of markup they paid plus adjustments for returns or refunds, pre- and post-judgment interest, attorneys’ fees, court costs, and a service award for the named plaintiff. Average individual payments for qualifying Class Members are estimated to be about 89 percent of the markup charged.

UPDATE 2: On April 30, 2019, the Court dismissed the appeal to the Safeway Grocery Delivery Class Action Judgment. This dismissal will become a final mandate on May 21, 2019. The settlement administrator estimates that checks will be mailed six to eight weeks after the mandate. I have emailed all the attorneys who are listed on the class action info page and have not received any responses regarding the mailing of the checks. I have been a delivery customer of Safeway since 2007 and am continuing to be using them to this day (May 18, 2018). Would be very nice to get that check as I am elderly, almost completely house-bound and the money would be a nice chance to get a few things I haven’t been able to afford since being forced into retirement in 2013. Living on Social Security in Washington State is very difficult as the rents here are astronomical and I can’t get housing due to the application period is closed and, if it ever opens, only 1500 people get chosen thru a lottery system. I am TERRIFIED of being homeless as I do not have any family and am all alone. With less than $200 a month to cover food, cleaning supplies, emergencies (like dental), and a new pair of shoes once a year (I can only wear sneakers) it’s tuff. If you have any suggestions on how to get additional help (I don’t qualify for food stamps, medicare, or housing…make 24 dollars over the limit (!!)…I am scared.
I was in contact with them a week or so ago they are awaiting the final Distribution Paperwork from the Court. Once They Have That then the checks will be sent and the website also will have the update and check distribution dates. The Attorney I spoke too said it usually takes 6-8 weeks after the final hearing which was March 29th.
I spoke with the Class Attorney the other day and he said they expect the Final Document too be signed for Check Disbursement in the coming weeks. The Hearing was a month ago so he said just be patient it will be shortly

Has Anyone Received Their Percentage of this 42k lawsuit that was officially over on March 29th(Final Settlement Hearing)?. Its a month later and No Updates Available on Payment Distribution on the Website. This Notice was premature and says that checks have been issued back in December. False and Misleading Statements
I lived in Camarillo CA and moved to WI 2 yrs ago..I received a notice about this suit by mail…I needed to change my address to the judgement administration, they must have received it because I got a card…but I have not received a check yet…just a fyi
I just checked the website and still no update on if/when checks are being issued/sent as Mr Tassin suggested in his December 20th article that checks had started being sent out too class members. We didn’t get the notice until after the first of year inregards too the March 29th Hearing
Spoke too one of the class attorneys and he is expecting the final approval from the court in the coming weeks shortly after that is when checks will be issued
I am disabled and I rely totally on Safeway delivery every month. When will they be mailing out checks?
If you email the claims administrator for an update of if/when checks are being issued and sent they are non-responsive to emails. I emailed them 2 times after the March 29th Hearing No Reply. If They started mailing the checks out before the Hearing this notice was premature on the topclassactions part. No updates have been published on the actual website to indicate checks have been issued and sent very frustrating
PLEASE add me too. It was to good to be true. Sometimes I don’t feel like shopping and waiting in line so I have used them.
This happened to me with Ralph’s grocery store in California. They use “Instacart” and so I called Instacart and they said that Ralph’s changes the prices for the people who get their groceries delivered.
