Safeway paid $41.9 million to end allegations that it forced consumers to pay more online for groceries than in its grocery stores.

Under the terms of the Safeway online delivery class action settlement, Class Members included those who registered for grocery delivery service on Safeway.com between April 2010 and December 2014.

Lead plaintiff Michael Rodman lodged the class action against Safeway in 2011 after he allegedly discovered the store tacked on an extra 10 percent to the price of items the store sold through its online grocery delivery service. According to the complaint, the extra 10 percent was in addition to a $7 to $13 delivery fee.

Further, the 10 percent upcharge was charged despite the grocer’s representations that the prices charged for the Safeway online delivery service would be the same as physical locations of the store.

For example, if a grocery item cost $4 at a physical Safeway location, according to the class action lawsuit, the item would cost an extra $0.40 online.

The Safeway online delivery fee class action lawsuit accused the store of duping consumers into using and paying more for the service than they expected. Safeway, according to the complaint, violated several California consumer protection laws.

In 2017, Safeway agreed to pay $41.9 million as part of a class action settlement agreement, though the grocer did not admit any liability. However, the settlement agreement was disputed, delaying the claims process until 2019 when a federal court dismissed the appeal.

Under the terms of the settlement, Class Members include those who used Safeway.com to order groceries online for delivery between April 2011 and December 2014. Those who used the online service more than once were entitled multiple claims. Class Members can expect to receive an award amounting to approximately 89 percent of the markup fee they paid.

The amount of each Class Members claim was based on the markup they paid for the delivery service during the Class Period. Class Members were automatically entered into the class action settlement.

The deadline to object to the Safeway online grocery delivery class action settlement was March 2, 2018 and the dismissal of the objection to the settlement was made final on May 21, 2019. From that date, Class Members should expect to receive a payment from the settlement within six to eight weeks.
