RushCard Class Action Lawsuit

A settlement has been reached in a class action lawsuit that alleges RushCard prepaid debit holders experienced a lengthy service disruption that caused them to be unable to access their money. If you were a RushCard prepaid debit card holder on Oct. 12, 2015, your rights may be affected by this class action settlement.

If approved, the RushCard settlement would resolve four class action lawsuits that were filed against UniRush LLC d/b/a UniRush Financial Services, Rush Communications LLC, Rush Communications of NYC Inc., Meta Financial Group Inc., MetaBank, and MasterCard Incorporated.

According to the RushCard class action lawsuits, UniRush LLC offers the RushCard to consumers through an agreement with MetaBank, the card issuer. On Oct. 12, 2015, a subsidiary of MasterCard became the processing company for RushCard services. RushCard holders were notified in advance that there would be a short disruption in service on Oct. 12, 2015 to allow for the conversion to take place.

However, the plaintiffs allege, the RushCard service disruption was longer than anticipated and left many users without the ability to access the funds in their accounts. According to the RushCard class action lawsuits, many cardholders were unable to pay for basic necessities such as food, rent, gas and electricity. Some cardholders reported discrepancies in their RushCard account balances, and some claim they were charged for balance inquiry fees when they attempted to withdraw money from ATMs while the RushCard system was down.

The defendants deny any wrongdoing but have agreed to pay $20.5 million to settle the RushCard class action lawsuits and avoid the burden, expense and uncertainty of ongoing litigation.

Class Members who wish to opt out of or object to the RushCard class action settlement must do so no later than Aug. 30, 2016.

Who’s Eligible

Class Members of the RushCard settlement include all cardholders with an open RushCard account as of Oct. 12, 2015 and who had authorized the use of that account at least once between July 14, 2015 and Oct. 12, 2015.

Potential Award

Up to $500 for reimbursement for losses suffered during the service disruption plus reimbursement of fees.

Class Members are eligible to receive reimbursement of fees incurred during the service disruption and a cash payment for losses they experienced due to the service disruption.

Proof of Purchase

Class Members who wish to obtain a cash payment must submit a Claim Form by Aug. 30, 2016. If you submit documentation of your losses, you may be eligible for a payment of up to $500. Class Members who do not submit documentation of their losses may receive a cash payment of $100. Payments may be reduced on a pro rata basis depending on the total amount of approved claims.

NOTE: No Claim Form is required for Class Members to receive a reimbursement of fees. Class Members will automatically be reimbursed for all fees assessed on their RushCard accounts during the period of Oct. 12, 2015 through Oct. 31, 2015 (except for fees that were previously reimbursed or credited to the user’s account).

Monthly fees for the month of October 2015 will be prorated so that Class Members will be reimbursed only for the portion of the fees allocable during that time period.

    Isn’t it customary in lawsuits of this nature that final approval of the settlement is usually given BEFORE the claim filing deadline is set? At this point, God only knows when we will get our checks.

      In this case, the claim deadline closed first which was Aug 30 and the hearing was sept 12. The final approval was successful and I’m sure Russell Simmons want this to be handled as soon as possible. So the”effective date” is ten business days after sept 12 according to the documentation provided on their website. By this time rushcard must hand over the settlement funds. The website also mentioned we should receive our funds within 45 days of the effective date which would be sept 22. And clearly he has had the money set to the side since the beginning. So let’s all be a lil bit patient.

      I’m guessing we have to wait for the “effective date” which is 10 business days from September 12. Within these 10 days, funds must b turned over from rushcard for the settlement within the ten day period. And we should have the checks within 45 days after effective date. We r one step closer to receiving our settlement funds!

          I believe we will be sent settlement checks and the funds will not go to the cards.

        How do you know its 45 days? I’ve read it can be up to 4-5 months for settlement checks like these to all be issued in these kinds of lawsuits

        The court granted the settlement final approval on 9/12/16. There were not any appeals filed, which is great news! The claim deadline was 8/30/16, and the settlement website states that the claim review process should be completed by around the third to fourth week of November, with payments made shortly after. The settlement website has a “Contact Us” option allows you to send an email to the settlement administrator.

    I had to pay a $40 late fee for my car note and a $4.99 fee to process the payment as well as a $50 late fee on my rent because of this.

    I have had money come off my card, so I request new card same thing. They always denied my claims, even when I am on phone with a rep to report this and money is coming off my card as we speak. I have lost over 200.00 with rush card and still can’t get my money back. I don’t recommend this card to anyone!

      Im closing my rush account soon too. 2 months ago i got money from a Savannah River Credit Union Atm. the machine did not give me my money i requested. there was a bunch of other people that it happened too also. Rush gave me the money that i requested from the ATM machine. it was reimbursement until they do investigation. well they did an investigation and Rush said that i was a liar and SRP too. I wouldnt lie about 80.00. im surprised at SRP too. UNTIL my people” AFRICAN Americans” own our own banks, we going to continue to get fuc##. they all in it together.

    Hi my name is Adrein Pimpton and I had a RushCard around that time until I beleve til the begining of the year March or April 2016,I still have the debit card and would like to know if I qualify for a part of the settlement because my money was held up rent was late, electric was too and when that happens I end up paying late fees. It was’nt easy.

      Just an FYI, but the company admins. for this claim don’t read these forums…at least don’t respond to them…If you have questions you should go to the website that is listed or contact them directly.

    I was evicted and forced to live in my car because it is up for Repo because it’s 2 going on 3 months behind, it was actually being towed with me in it, but I called the police and told them I was being kidnapped and after a 5 hour stand off the tow driver let me go, I’m a in home care provider that can’t work with out a vehicle.

      I have been a customer for 7 years, I got my settlement. What a joke, they put it on my card Nov 9, 2016 and the amount was $3.50. I’m getting away from rushcard period. You can never talk to a live agent. You continue to press all these buttons and number and a live agent never comes on. I’m pissed off and will never go back to rushcard. They are a rip off. Everyone get out and please pass this along. I will never recommend them to no one.

          I’ve had this card for 5 yrs now and yes my check did not go on my card for a week had to pay all type of late fees because of it and I didn’t even kno I could file a claim until I seen they only have me 11 dollars back really. I even had my mother sign up for there card and my daughter’s mother if I knew this is what having there card is about I would’ve never signed up in the first place very disappointed
