River City Bank agreed to pay $140,000 to resolve class action lawsuit claims surrounding a 2020 data breach that compromised sensitive information.

The settlement benefits River City Bank customers in California whose personal information was compromised in a data breach between Sept. 27 and 29, 2020. Corporations and other companies are not included in this settlement, even if they bank with River City and have a California mailing address. According to the settlement notice, there are 16,417 Class Members included in the settlement.

River City Bank is a California-based financial institution offering both commercial and consumer banking solutions. According to the bank’s website, River City has over $3.5 billion in assets, making it the “largest, independent, and locally-owned and managed bank in the Sacramento region.”

In 2020, River City Bank was the victim of a data breach. 

According to a data breach notice provided to the California attorney general, a bank employee performed unauthorized activity in late September 2020 when they downloaded customer data to a personal storage device. The employee then sent this information to a third party.

Customers affected by this breach quickly took legal action against the bank. The data breach class action lawsuit argues River City Bank had a duty to protect customer data but failed to do so. As a result, sensitive consumer information was allegedly compromised — putting River City Bank customers at risk for identity theft and fraud.

The class action lawsuit also challenges the way River City Bank handled the breach. 

Despite learning of the breach immediately, the bank did not inform customers of the breach until November 2020. The data breach plaintiff says this period of over one month could have been used by affected customers to safeguard their information and implement credit monitoring.

River City Bank hasn’t admitted any wrongdoing in the data breach but agreed to resolve these allegations with a $140,000 settlement. 

Under the terms of the deal, settlement class members can collect a cash payment. According to the settlement notice, each payment will be around $3.26. Exact payments may be higher or lower depending on the number of class members who participate in the settlement.

The deadline for exclusion and objection is July 11, 2022. 

The final approval hearing for the River City Bank data breach settlement is scheduled for Oct. 26, 2022.

No claim form is required to benefit from the settlement. Class members will automatically receive their share of the settlement through a deposit into a River City Bank account or through an electronic payment through PayPal, Venmo or Zelle. Class members receiving electronic payments may want to update their email address with the settlement administrator.
