Rexall Sundown Inc. and NBTY Inc. have agreed to a class action settlement over allegations they made false statements on the labels of some of their joint health supplements.

Consumers who purchased certain glucosamine and chondroitin joint supplements manufactured by Rexall Sundown may be entitled to compensation from the class action settlement.

If approved, this settlement will resolve a class action lawsuit that alleges Rexall and NBTY made false statements on the labels of their glucosamine and chondroitin joint health supplements. The plaintiffs do not assert any allegations related to the safety of the joint health supplements and have not alleged any injuries.

A settlement was initially reached in this class action lawsuit in 2013, but the settlement was not approved by the court. No payments were made under that class action settlement.

Rexall denies the allegations and stands by the efficacy of its glucosamine joint health products. However, the supplement maker agreed to settle the class action lawsuits to avoid the risk, expense and delay of trial.

Who’s Eligible

Class Members of the Rexall glucosamine settlement include all consumers who purchased certain joint health dietary supplements that were manufactured or sold by Rexall or any of its affiliates.

The covered products include dozens of glucosamine supplements sold under brand names such as CVS, Duane Reade, Equate, Kirkland, Kroger, Safeway, Target and Walgreens. A list of the covered products is available here.

Potential Award

Up to $104 per household.

Class Members who submit a valid and timely Claim Form will be eligible to receive a payment of $8 per bottle of Covered Product purchased, up to a maximum of 13 bottles per household.

NOTE: If there is money leftover in the settlement fund after all claims, awards, fees and costs are paid, the remaining funds will be distributed pro rata to all Class Members who filed timely and valid claims, up to a maximum of $200 per household.

Proof of Purchase

Proof of purchase is not required to submit a claim; however, claims may be audited for completeness, fraud and abuse.

    The court’s final approval was on August 25,2016. An appeal was filed September 27,2016. I thought they only had 30 days to file an appeal? So how were they able to file an appeal after the 30 days passed?

    If the case settled June 2016 and a 30 days appeal after August no appeal can be file right so how do this one get 60 days to file can any one tell me that and by the way good day to all.

          It looks like there were four appeals filed with the 7th Circuit Court of appeals. The window for any additional appeals to be filed has expired. Unfortunately, appeals can take several months or even years to resolve.

      Is this normal, to say there is a settlement, and to look for your checks – then to have another appeal filed??

        There is a 30 day time period after the court grants final approval in which appeals can be filed. We are always hopeful that once a settlement receives final approval, there will not be appeals filed. However, that was not the case with this settlement.
