PTZ Insurance has agreed to pay $5.5 million to resolve class action claims that they placed robocalls using a prerecorded voice to consumers regarding a 30-day gift of insurance.
The settlement will provide benefits to individuals who received a phone call from PTZ Insurance that used a prerecorded voice to play a Day 2 or Day 6 message between Oct. 16, 2013 and Nov. 30, 2016.
Plaintiff Christopher Legg filed his class action lawsuit against PTZ Insurance Agency in December 2014. Legg claimed that PTZ placed unsolicited telemarketing calls to consumers using a prerecorded voice in violation of the Telephone Consumer Protection Act.
The Telephone Consumer Protection Act (TCPA) is a federal law that protects consumers from harassing calls, texts, and faxes sent to them without their consent. Under the TCPA, consumers can file lawsuits against businesses and seek up to $1,500 in damages for each call that violates the law.
PTZ has not admitted any wrongdoing by settling the TCPA claims against them. Instead, the insurance company has agreed to pay $5.5 million so that the claims can be resolved without the time, costs, and risks associated with continuing litigation.
The amount each Class Member will receive depends on the amount of claims filed. With a five percent claim rate, Class counsel estimates that payments may be around $92. With a claim rate of 10 percent, Class counsel estimates that payment may be around $46.
After payment of Class Member awards, attorneys’ fees, court costs, and the plaintiff’s service award, a second round of payments will be made if there are enough funds for each Class Member to receive $10 or more. If a second round is not justified, the remaining funds will be donated to the National Association of Consumer Advocates.
In order to receive payment from the PTZ TCPA settlement, Class Members must file a valid claim by Aug. 28, 2019. The deadline for exclusion and objection is Aug. 28, 2019. The final approval hearing is scheduled for Oct. 31, 2019.
Who’s Eligible
Individuals who received a phone call from PTZ Insurance that used a prerecorded voice to play a Day 2 or Day 6 message between Oct. 16, 2013 and Nov. 30, 2016.
Potential Award
Around $92, based on Class counsel estimates.

To file a claim online, Class Members must provide their unique claim number and PIN.

I just checked USPS Informed Delivery… it seems like another check today 7/2. Anyone get anything?
I received another check for $54.07 today.
I also got a check for the same, came here to see why since I thought it was closed after they paid out the additional $37. I still don’t see anywhere what part of settlement this came from. Possibly people didn’t cash the checks in the allotted time frame and the money left in the account may have been split amongst those that did?? They can’t keep the money themselves.
I found this check in my mail stack. Almost threw it out thinking it was fraud because I didn’t remember this! Whew! Thanks!

I received a check as well for $595. The claim number on it matched the claim number when I filed my claim last August. I am not submitting my W-9 for the extra $37.22. I had no clue we would get so much from the settlement! It really helps right now with all of this Corona Virus madness.

We recv’d a check for $595 w request of w9 in order to recv additional $37.22. Other than cashing the check @ BoA, has anyone deposited the check in their own personal bank?

I received one too. I do remember filling out the form to file for the class action lawsuit. Not sure about cashing the check. I did research & see the lawsuit. It’s a Bank of America check. I think I will take it there to cash.

I received a check as well and I took it to Bank of America and they cashed it. They said that the check was good. There just were probably not as many people as they expected that joined the class action suit.

Has anybody cashed their check? I also received one for $595 with an additional $37 if I send in a W9. I just received it 3 days ago in Missouri. Trying to find out if it’s legit. I did adopt a dog around the time and remember the robo calls but not sure I ever filled out a claim.

Ditto here in Kansas. Received same letter and check dated March 17, 2020 and asking for an executed Substitute Form W-9 with my SSN to send final $37.22. I am treating it as a SCAM unless I am informed otherwise. I don’t remember filing for this, but I did adopt a pet who was microchipped during the time period covered.
Hi, I did research, it is legit. Those people that were robocalled, their numbers are on a list provided by the company. So that list was cross referenced, and the joining of the class action was automatic

I received a check for $595 but asking for my SSN to send the remaining amount. I’m treating it like a scam but it says its related to this class action.
I e-deposited my check with my bank (Ally), and a couple of days later it was approved. I was leery when I first got the check too, but I’m glad I decided to try depositing it.
I only submitted the $595 check and didn’t bother with the extra $35 that needed a tax form.
