Several drug manufacturers have agreed to pay more than $65 million to resolve claims that Provigil, Nuvigil, and generic modafinil were part of a price-fixing scheme.
The settlement benefits both a national Class and a California Class. The national Class includes consumers or third party payors who paid for or reimbursed the cost of Provigil or modafinil between June 24, 2006 and Aug. 8, 2019 in various states. A complete list of eligible states can be found in the “Who’s Eligible” section below.
The California Class includes consumers from California who purchased Provigil, modafinil, or Nuvigil between June 24, 2006 and Dec. 31, 2012.
Claims in national and California state class action lawsuits claimed that companies conspired together to fix the price of Provigil, Nuvigil, and generic modafinil. These medications are prescribed for the treatment of narcolepsy and other sleep disorders.
The two Provigil price-fixing class action lawsuits included claims against Cephalon Inc., Teva Pharmaceutical Industries Ltd., Teva Pharmaceuticals USA Inc., Barr Pharmaceuticals Inc., Mylan Pharmaceuticals Inc., Mylan Inc., and Sun Pharmaceuticals Industries Ltd. These defendants have agreed to settle the claims against them.
Cephalon agreed to pay $48 million into the settlement fund while Mylan agreed to pay $14,377,600 and Ranbaxy (represented by Sun Pharmaceuticals) agreed to pay $3.5 million. In total, the settlement fund is $65,877,600.
California Class Members may be eligible to recover compensation from an additional $69 million settlement reached between the California Attorney General, Teva Pharmaceuticals, and Cephalon. The consumer portion of this settlement is $25.25 million.
Both consumers and third party payors will receive settlement payments based on the amount they paid for the medications compared to the amount paid by all other consumers or third party payors who file a valid claim.
In order to receive payment from the settlements, consumers need to file a valid claim by Jan. 15, 2020. At least one form of proof of purchase is required to file a Claim Form. This may include pharmacy records, an explanation of benefits from an insurer, or a letter from a doctor stating that the medication was prescribed during the relevant time period.
The deadline for exclusion is Dec. 6, 2019. The deadline for objection is Jan. 15, 2020. The final approval hearing for both settlements is Feb. 26, 2020.
Who’s Eligible
National Settlement Class: Consumers or third party payors who paid for or reimbursed the cost of Provigil or modafinil between June 24, 2006 and Aug. 8, 2019 in Alabama, Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Kentucky, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Mexico, New York, North Carolina, North Dakota, South Dakota, Tennessee, Utah, Vermont, West Virginia and/or Wisconsin.
California Settlement Class: Consumers from California who purchased Provigil, modafinil, or Nuvigil between June 24, 2006 and Dec. 31, 2012.
Potential Award
Varies. Consumer payments will be calculated based on how much was paid for the medications compared to the amount paid by all other consumers who file a valid claim. Third party payor payments will be calculated in a similar way.
Proof of Purchase
At least one form of proof of purchase, including pharmacy records, an explanation of benefits from an insurer, or a letter from a doctor stating that the medication was prescribed.

ORDER GRANTING PLAINTIFF STATE OF CALIFORNIA’S MOTION FOR ORDER
AUTHORIZING DISTRIBUTION OF THE CONSUMER FUND AND PERMITTING
ADDITIONAL LATE CLAIMS
On June 10, 2020, the Court granted final approval of Plaintiff State of California’s
(“California”) Consumer Settlement with Defendants, approving, inter alia, the proposed
Distribution Plan to disburse the Consumer Fund first through direct cash payments of claims
from Eligible Consumers that have been vetted for legitimacy by the Claims Administrator, and
thereafter through cy pres distribution of any portion that remains unclaimed to be administered
by the Cy Pres Administrator. (ECF Nos. 32 and 33.) On September 20, 2022, California filed
the instant Motion for Order Authorizing Distribution of the Consumer Fund and Permitting
Additional Late Claims (“Motion”) (ECF No. 37), accompanied by the Declaration of Eric J.
Miller (“Miller Declaration”) with exhibits.
Having considered the unopposed Motion, the Miller Declaration, and the pleadings and
other papers on file in this action, there being no objections to this Motion, and finding good
cause appearing, the Court hereby GRANTS the Motion as follows:
1. The administrative determinations and recommendations of Claims Administrator
A.B. Data, Ltd. (“AB Data”), concerning the 11,012 Claim Forms received in this action through
June 17, 2022 are hereby APPROVED.
2. The disbursement plan recommended by AB Data in Paragraph 20 of the Miller
Declaration is APPROVED. The Court authorizes AB Data to distribute from the Consumer
Fund a total direct cash payment of $8,145,552.69 to the 6,169 claimants whose Claim Forms
have been approved by AB Data and who are listed in the Eligible Consumer Claims Summary
attached as Exhibit F to the Miller Declaration, including the 234 Claim Forms received after the
January 15, 2020 deadline prescribed by the Preliminary Approval Order.
3. The Court further authorizes AB Data to accept and process additional Claim
Forms against the Consumer Fund so long as such claims are submitted by potential Eligible
Consumers who have not yet submitted a Claim Form in this action and they are received by AB
Data within ninety (90) days from the date of entry of this Order (hereinafter, “Late Claims”).
All validated Late Claims shall be presented to the Court for approval within a reasonable time
upon AB Data’s completion of the vetting processes provided by the Final Approval Order.
4. At the conclusion of AB Data’s administration of the Late Claims, any funds
remaining in the Consumer Fund shall be processed by the Cy Pres Administrator for cy pres
distribution in accordance with Section II of the approved Distribution Plan attached as Exhibit 4
to the Settlement Agreement (ECF No. 2-3 at pp. 104-107).

In the document posted on the Settlement Website they have a list of approved claims with claim numbers and the number of bottles you claimed.. It’s amazing that only 14k people signed up for the settlement and only 6700 plus claims were accepted and they wonder why so much money was left in the settlement. It’s like they did everything they could to deny as many claims as possible? What was the point of doing the settlement if they were only going to approve so few people? O well good luck to all the people who got their claims approved… I guess now it’s up to the charity organizations to do the right things with the money to help as many as they can but we already know what will happen with that…

Correct – The Calif payments are still being calculated and have yet to go out.
I mean how long does it take to do calculations? They promised the Judge they would have this done by March and they are still doing the calculations. I will be more than happy to help them!!!!!!! I guess we have another year before we get paid…..
Called ABData today and they said they had no idea how long it would be until checks were mailed out. I reminded this person that in June I was told in sixty days checks would be issued and mailed. His response was that the judge, attorneys and State of California were arguing and not in agreement.
I saw on the California Provigil website under Court Documents that two new documents were filed on Sept 20, 2022. One was a Motion for Order Authorizing Distribution of the Consumer Fund and the last one was Proposed Order Granting Plaintiff State of California’s Motion for Order Authorizing Distribution of the Consumer Fund. What does this all mean? Do these Orders still have to be signed by the Judge or ?
Can someone with some knowledge of how the legal system works, please look at these two documents and give some clarity. Hope this gives some hope to those of us still patiently waiting for our share. Thank you to whoever takes the time to examine the documents and gives an explanation as to what these filings actually mean in terms of checks finally being issued.
Looks like they actually are trying to pay the Cali settlement but we still have no clue when it will actually will… The settlement company will use every bit of the 90-day agreement on payment to send anything or ask for an extension.. Fingers crossed this will actually be resolved soon!!!!

I received a check for over $6,000.00! I did, however, have substantial pharmacy records. This was only about half of what I spent on Provigil or the generic, though. I’m glad I got something back.
Just curious when you got this check. Was it with the first payout of this one or the Multi State one?

No checks for the California Attorney General class actions have gone out yet, at least as of June 6th. I was told that all claims had to be reviewed/processed before any checks would go out.
I am beginning to believe that “ no individual” has received any payments. No comments suggest that payments were received.
The first payments were issued Feb/2018. Secondary payments went Oct/2019. This second round lawsuit was then created with national payments being issued March/2022. The Calif payments are still being calculated and have yet to go out. Some have complained about less than expected amounts for the March/2022 payments, but the total payout including the previous-lawsuit payments are factored in such that the total does not exceed original claim amount.

Are you going to print a list of all participants and the amount they received? I should have received a settlement payment and I still have not gotten any correspondence.
Around June 6th I called the phone # on the California AG site (don’t know if it was for AB or ?) They identified me by my phone number and said that yes I had a valid claim. They weren’t able to tell me how much I would be getting bc they were waiting on the State of California to tell them the amounts. They were processing claims and told me that they thought they would be sending checks out in 60 days.

I contacted the President of A&B Data and he no clue that settlement was not being paid and he will investigate those working for his company because the worker is stealing our money. Poor company to work for.
I just wonder what will happen now.. Since they were willing to lie to the judge and delay payment how much longer will we have to wait now or will this just keep us waiting longer? O well we are still at the same place we were 5 years ago with no resolution in sight..
I just got off the phone with them and they claim payouts we’re sent in March. The amount I paid was conveniently cutoff from the documents I sent and the amount I was due to receive was too little to be disbursed. All sounds fishy to me.
Many calls and letters to A.B. Data, Ltd and no response. Checked into this company and found out that they do not like to pay the settlements and that is why so claims are processed with them It needs a investigations.
I got a check from them March 2022
I was prescribed Modafinil waaaay back in 2006 for about a year. We’re talking right at the beginning of the timeframe covered in the suit.
I went through every option available to me to try to provide proof. I called CVS/Walgreens to get records, but was told they don’t keep them that long. I called the student health office where the doctor who wrote the prescriptions worked–he had long since retired and the school only keeps student health records for 12 years. I do not keep random receipts that long.
The only proof that I had was a doctor’s memo (unrelated to provigil, that stated that I had at one point been on it.)
I literally had no way to prove that I was a member of this class. You’d think that their ability to identify and send me information about the suit would be helpful. But given the payouts people seem to be getting, looks like I didn’t miss out on much here.
I submitted a very detailed letter regarding the very same information that you have. Mine goes all the way back to 2011. I have not seen a dime.
The settlement attorneys, in this case, lied to those individuals whom they sent notice to. Stating that even if you received funds from a state AG settlement you would be considered a class member of this suit and entitled to settlement funds. When I found out they were paying out claims I followed up on my claim and was told I was not able to collect on this action because I had collected on one of the States AG’s settlements. Furthermore from what I can make of this settlement and the way the settlement is being done anyone who paid cash would only get 14% of the final consumer award funds whereas the insurance companies who were not able to rake in tons of money through the AG settlements will get the bulk of those funds up to 86%. SO there you go Who do you think made out in this antitrust lawsuit. Because when you add up what you might have paid out of pocket for this drug over 6 years without insurance you will never get that total amount back. Or even half the cost! But have no fear any insurance company that covered the cost is going to recoup 100% of what it paid!!! Tell me who you think is more important when it comes to settling an Anti-Trust consumer lawsuit. If you think it is the American consumer better get your head straight. It happens to be just someone else who is a member of the 1%. Money Begets Money!!!

AB data is a RIP off, they are stealing people money, me and my mother where taking provigil and sent proof twice and was still denied. These reps are working from home and putting in fake names and paying themselves. I will contact the state attorney general office and report them.
I’m part of both settlements. I called yesterday and was told that regarding the multi state settlement, it would cost more to cut and send me a check than the amount I would receive so that I get nothing. My claim was for approximately $2,500. I was told to send an email for a breakdown. I was also told that they have no idea when the California settlement would pay out.
I just called and was told that I was already part of the previous claim and so I would not be getting anything!!!!! I haven’t been part of any other claims (ever!) this is bullsh*t. I person i was talking to just kept telling me to send an email as she could do anything. So i have done that lets see what happens…………….
So this was the email reply i got from them on Wednesday 13th
“As per the Court Approved Plan of Allocation, your claim is not payable in the Class Action portion of this Settlement due to the following reason:
Your claim is scheduled to receive payment from the CAAG Settlement, which is expected to be finalized in the next couple of months.”
So i guess we are just still waiting ???

called back again on 03/28/2022 and the person sound as if they were off shore and wanted to asked me a million question and finally said that checks were mailed and she would not confirm on mine nor would give direct answere but wanted to ask question. Heard dog barking in the back ground and person failed to say if all of the checks were mailed out. Still no check in Ohio

After several emails requesting how my claim was calculated (and receiving generic responses) I have a new email group at aba responding they have received my request and will respond in 3-5 days. My lawyer has advised me they have to provide the information. I have the file downloaded with the approved claims submitted to the courts by aba. Which of course is per documents, everyone will receive a portion of the whole, which is your approved claim amount % of the total claim amounts total. That is your percentage of the available amount. Which is the discrepancies issue right now. It’s not being applied correctly per their submitted documents. If you would like the document that was submitted for original approved claim amounts (again not the actual payouts) provide your email and I will send the court exhibit.
I received approx. 45% of my submitted claim in March.

Didn’t you all get paid on a similar settlement? They said in a post here you all were overpaid and the settlement didn’t have enough money in it so they get their funds back on this settlement???
The previous settlement was different. If you lived in Pennsylvania the previous settlement was for. I submitted my claims and was paid for the prescriptions I paid for only residing in PA. This settlement is different and you can’t be penalized for another settlement miscalculations.

My check was 22% of my total claim for which I had proof of purchase AND physician letter.
I provided the same and received 5.6% of my claim amount. I called and was given the project managers email. They responded with the most generic response ever. I’ll be writing the judge. I’ve seen several claimants receiving 20-38% of their claims and I get less than 6%… time to write the judge!

Mine is 2,015.99 and my claimed amount was $8,745. 23% was my restitution with proof for the generic Modafinil. I was never in any other Provigil settlement either. Curious to know others . Wondering why it didn’t detail the percentage reason…
I had no explanation at all. I have my total approved claim amount on the court documents. And there are more claim values than the total amount. Mine was reduced to 5.6% when most are getting 20-35%. I blew up the settlement Facebook as well.
I claimed about 3,800 and received $360.
The cypresfunds california website was established for California non-profits to submit applications. There is going to be around $40 million leftover from the California fund and it goes to non-profits. I was also told that people who received a payment from the first provigil settlement a few years back will have that amount deducted from any award from this settlement. That’s because the money for this lawsuit came from a defendant that didn’t settle back then. Let’s say you received $300 from the first provigil payment. If you were eligible for $800 this time, you will only receive $500. California did not accept that settlement and that’s why California residents were not eligible for the first provigil claim form. They are eligible for payment from both funds this time but the California fund is going to cover the claims from the California side. What really slowed down the payment process for this lawsuit was having to compare claims to the claim forms that already paid out a few years back.

I don’t understand how the first class action (which was for generic delays) could correlate to this lawsuit (which is for price fixing).
In addition, my payment from the generic delay class action plus payment for price fixing lawsuit received today still falls well below 50% of my total price fixing claim when both amounts are added together.

I got the following email this morning ….
“We are currently awaiting approval from Class Counsel of the final pro-rata calculations, based on the amount awarded and the number of eligible claims in this case. There are three sets of Class Members that are being prepared also we expect this to be finalized in a couple of weeks and then we can prepare the mailing of the checks, which will take about 10 business days to generate and mail, once we receive the approval, so we expect this timeline to be within three to four weeks for completion. It could be slightly longer, but this is our best estimate. We appreciate your patience in this matter”

No, but I talked to someone at AB Data today. Again, they reminded me tat this was a very large case with many variables and there was no known timeline for distribution. They said be patient. More of the same!
They informed me when I called this morning that payment would be in 30-60 days. So many different answers they are giving people. The longer they hold the money the more they earn in interest.
Completely untrue. They cannot distribute until the Court signs off on the Distribution Order. And any interest accumulated up to that point stays in the settlement fund and is divided up between the eligible claimants. AB Data has a set fee. They don’t get to keep interest. Every single penny is accounted for. You’d think you serial fraud filers would know how this works by now.
I’m not sure who you are calling a fraud filer, but I know it’s not me. And if you go back and read the court papers they do in fact get to keep one-third of any interest. So don’t be mean and nasty. Some of us have never been involved in a class action before.

attorneys’ fees in the amount of $21,959,200, together with one -third of the interest on the

The Law Firm is paid first so they only get 1/3 of interest until that date they are paid. The Settlement Administrators do have a fee they charge but they can ask the court to get more money if they feel the expenses will be more than they asked for. That extra money if approve is taken out of the settlement fund. Interest is placed in the settlement fund and is included in the final amount paid out to approved claimes. It looks like you both have some true factors in your statements but as far as I know this is how it truly works. Please update me if I am not correct.

I really wish we could make bets on if we will get paid this month.. This has lasted forever and it seems like it will never end. No new updates so we are still at a standstill,
I would like to have the information to contact the judge in this matter and let the court know how things have been handled. After years of waiting, it is a bit of a stretch to ask us to be patient.
The judge is aware of the slow response to this case since the letter was sent and recorded in the case. Now if they go against their word I just wonder what’s going to happen? They said March but knowing them they will wait till the last day of the month to send anything out.
I thought the court docs said it would be a “minimum of 60 days” from the date that distribution was approved? That means no checks will be mailed until AT LEAST those 60 days have passed.

Thank you for the update. This actually applies to both settlements National and California. This was a response to a letter from a claimant in both the national and California claim.
I was not aware of that since I am just in the Cali one. This is great news for everybody if it actually happens. I guess in a few weeks we will all know for sure.
All other states: A general Motion for Distribution was filed in December and it was approved in January. A pay out occurring in a “minimum of 60 days” means not before that time, of which it has not yet been 60 days since the Approval for Distribution was given. However, it is not our choice, as we are waiting on Counsel to move forward with the distribution factors. We understand your frustration and ask your patience in this settlement. It is extremely large, contains multiple levels within the settlement which are not all finalized.
Hi, Where is this new information from? In the last letter from “counsel” on the docket he specifies distribution should be occurring beginning of March.
That sounds like another email from the distribution company. Another shove off email to keep everyone at bay. Especially since claimants are complaining directly to the judge.
I think it’s best to go by what’s on that actual case report. As of now the last update on 2/7 says payment should be going out in March. I will check to see if anything changes later. I or somebody else will post updates that are verified by Pacer or another case update site..
Just got off the phone with folks at the provigil settlement phone number…they know nothing. They dont know when the checks are going out they dont know how much anyone is getting. Then they refer you to their website for updates…I said nothing has been updated since April of last year to which they replied thats because their is nothing to update. Makes me wonder why they have those folks sitting around answering phone calls, which of course is coming out of the settlement funds.
Just saw on the docket a class member wrote the judge about the issues with the administrator, delays, updates, and no payments.Court ordered a response within 7 days. Hopefully this puts a fire under their butts we will receive payments soon!

I was just told “the class council” has to now approve. And I was promised that they have zero motivation to hold the money any longer. Which I believe them, because it is not like you could make interest on the money sitting in the accounts. Oh, wait guess you probably could, so why not wait another 60Days. The class council names are all listed on this page. I guess they are like, why not make them wait, it is not like they were screwed over by the Provigil people for years.
FYI the settlement fund has a set amount that the Settlement Company will get unless they ask for more and they can only get that if the Judge approves it. The interest is always included in the money they pay us. This information is found in all Settlement Agreements and other documents in the Important Document section in every case.. It really doesn’t do them any good to hold on to the money but they still do it way longer than I think they should. I feel we should get paid at the same time the lawyers do and that’s when the Settlement is Approved.. Just my lil opinion.
Will plaintiffs get that full amount that is labeled “authorized claim” on Pacer?
I am not able to see that section so I can not say what amounts will be sent. It is subject to be more or less per the Settlement Agreement. We are closer than ever to getting paid and all questions will be answered.

New email response: The Court entered an Order approving the distribution of settlement funds on December 21st, 2021. We are currently preparing final award amount calculations in preparation to issue payments. We anticipate checks bring mailed out in the next 4-6 weeks.

I looked into the legal filings, because it’s public. They did file a motion for dispursement of funds on December 3rd after they filed with the court with their update on status. They are trying to get the funds going. I can’t tell if it’s approved by the judge or not, but they did file it.
Yes I saw this as well Exhibit E contains the claim numbers of all the approved consumer claims. Not clear on whether or not the judge has approved.

As an update, there is currently no known timeframe for distribution. However, we are currently in the final stages of auditing and processing. We expect to present valid claims to the Court in the next 3-4 months for final approval. Updates can be found on the Settlement website.
WOW! Love how their response constantly changes. I was told 60-90 days when I called a couple months ago. I wonder who’s making all the interest off the money that’s sitting in the bank for over a year now. I understand there is a process and a lot of false claims but how many times are they actually auditing or just using the excuse for a year now. There should have been checks out months ago to the people they know are eligible and if there’s left over money simply send a second check at a later date. This company is extremely unprofessional and they could care less whether those checks go out now or in another damn year. It’s absolutely ridiculous!

As an update, We are in our final stages of auditing special claims. There is currently no known timeframe for distribution. Generally speaking in similar cases like this one it takes about a year from the claims filing deadline (which in this case is January 15, 2020) before distribution takes place. Sometimes it can be quicker. Sometimes it can take longer. Approval of Settlement is not Approval of Disbursement.
Any more updates? Anyone heard anything? Last I was told back in February was at least 6 months and I had no deficiency.
I was told last week that they had another audit in August that slowed things down. At this point they are hoping to do distribution before the new year.

So I have sent all my verification information in twice already. Years worth of proof from pharmacy, receipts showing I paid with no insurance coverage for years because insurance refused to pay although I have MS so it was out of pocket and then sent the current prescription and still paying for this medication to date. So I’ve received 2 emails verifying I am clear of any Deficiency and a letter stating the same. So yesterday I got an email demanding the verification information yet again with the deadline being November 29th I emailed back and forwarded THEIR emails stating I was good to go they argued with me stating that was then and not now and they have the right to deny my claim if I don’t send everything back in again by the deadline. Mind you the deadline is less than a week away during a major holiday week! So I already have an attorney working on something else so I’ve spoken to him and he is willing to take this fight. So is anyone else having issues with this company? If you have a VALID claim and have proof and your having similar issues email me! We will work together. This company is not screwing is out of our valid cllaims to pocket our money. Again EMAIL ME!!! We can fight back together!

Yeah well I have 2 emails and a letter stating I have no Deficiencies and needed to do nothing until I received an email yesterday telling me otherwise. Building a case if you end up with same issues!
The people claiming that distribution is going to take place in the next couple of months are lying. The administrators have never said that. They’re still sending out new letters asking for more information. That means distribution is not close at all. You’d think all you frauds would know how it works by now. Stop pestering them with calls and emails asking the same question. It only slows the process down. Just look at the website instead. When they have new updates, that’s where you’ll find them. It hasn’t been updated in a long time because there’s nothing new to report. That’s the way it works. Distribution will happen sometime in 2022. Be patient. Let them do their job. Constantly badgering them with the same old questions makes the process go slower.

Maybe look at old insurance paperwork, tax records for pharmacy receipts if you itemized, contact the pharmacy for old records, look for doctors in the area that you lived in to see if the names look familiar, call any doctor that you remember to see if they may have it documented in your records.

6 emails, 2 phone calls and two months later I get a reply. Deficiency is satisfied. Payout 30-60 days. That part I doubt. What is the hold up on this case?
I just finally ended up calling and speaking to a really nice gentleman on the provigil settlement hotline and he said that it still showing our claim is under review which he said that’s very common they are waiting for the money so they can start cutting the checks so check should go out in the next 30 to 90 days at the latest.
I called 3 weeks ago. I was told that my claim was all good. Payment was to go out in 30-60 days. Immediately. They have had the money ever since Judge ruled with the claimants. They just keeping making up stories as they go along.

Any updates as of today. I received a letter requesting proof, but pharmacy required 7-14 days to mail me documentation and I had three days to submit paperwork, so my doctor wrote a note. However I have heard nothing since that info was submitted. Just checking to see if anyone has received any further info. I pay 200$ for that medication and have for years. Would love some of it back….. esp considering it sales for 1700$ monthly and cost less than 1$ to make. Thanks
I was one of the people that supposedly filed two claims. I filled one out, then was contacted and told I filled it out incorrectly, and I filled out a second one. A year later I got a letter saying my claim was denied because I filed twice. I was not scamming, I was following directions and I’m sure I wasn’t the only one.

So are we all supposed to save EVERY receipt for EVER? I don’t have any receipts from 2006, do you? My pharmacy does not have any records past 18-24 month and if I paid out of pocket, which I did, they have no records at ALL. So, slow your roll. OF COURSE they send denials so THEY can pocket the funds. My Doctor will write me a letter attesting to the fact I was taking the drug but WHO KNOWS, that is not a receipt that shows I paid for it so I may still get nothing.

There is no hold up or delay. This is a very large settlement. And there is an enormous amount of work that needs to be done. While many settlements take around a year from the claims filing deadline, some of them take longer. We’ve seen cases that have taken as long as five years to complete. Because there are so many variables involved in a case of this nature, it is very difficult to accurately estimate the timeframe for distribution.
We would recommend pushing your calendar ahead six months. Also, you are welcome to check the website linked below. When there is new information to report, the website will be updated. Counsel’s information is also available on the website.

I called in January and they said things have been delayed due to the coronavirus and they said that we won’t start seeing payments most likely until March sometime
I’m still dumbfounded over how this lawsuit was never nationally disclosed. There have been countless number of class action lawsuits where info was provided not only by mail, but via television, radio and paper ad. Nothing!!! I didn’t know there was an earlier class action in 2018 or even one a few years ago, here in my state. This is ridiculous.
I chased up a reply from the “A.B. Data, Ltd., Class Action Administration” and they said “Your claim is currently deficient because the spreadsheet you provided is not sufficient to provide as proof of payment.” Which is confusing me because I did indeed sent them a spreadsheet of my payments but I also sent proof of payment which was a printout of my payments through my insurance?? does this mean I wont be getting anything?

No — He is saying he got $9000 from the “previous” Provigil settlement, not the California one. If you research it, you will see there were earlier settlements that were sent out in 2018.

I called and spoke to someone at the office and she said it’s still being worked on, but if you are in an extreme hurry you can find a local class action lawyer to take over the case for you! I also read, or was informed by my pharmacist that the total amount people would be getting was around 14% of the total amount being paid out, but with that being multi millions of dollars I kind of doubt it! But I was on this medicine when it first came out and no insurance covered it and it was about $10,000 per refill! So yeah some payback would be nice!
The payment is supposed to be full dollar-for-dollar payback of what we spent on Provigil taking into account our previous Provigil class-action payouts and the California lawsuit, as applicable. That is, no one should received a total of more than what they spent on the drug taking into account all of the payouts. If there are more valid claims than available funds, then it will be reduced pro-rata.

I have not received anything requesting more information for at least the whole month of April … so does this mean no news is good news? The only proof I have is 3 RX bottles from 2012/2013. My pharmacy has no records because it no longer exists and my medical records for the prescription can’t be found because the office has merged with another company since then.

For those asking why their state isn’t included, it’s because it was covered under the 2017 State A.G. settlements ( http://www.stateagprovigilsettlement.com/ ) . I had to purchase mine through the mail from Canada which came from Sun Pharmaceuticals until I was able to get my insurance to cover it after going through hoops to prove my need for them. Even then the copay was the highest tier. So why can I not file a claim just because of where I reside?

Texas? Really? You guys are a completely red state. Considering the Republican Party keeps trying to pass anti-consumer protection laws, and that republican judges tend to weight more favorably towards defendants in these cases, it’s no surprise that your attorney general opted out of litigation against a major company in a class action
I bought modafinil /provigil in 2 States , Washington State and Georgia. How come these States aren’t covered?

I got a check from a prior class action lawsuit in regards to the same medication about two years ago. I got the mailing for this one as well. I received over $3,500 for the last one. Fingers crossed this one is somewhat the same! I might actually recover most of the costs I incurred from this medication!

I was prescribed Provigil in Mississippi, but it was prior to 2006. I had to pay out of pocket over $300.00 per month. I’m just curious as to why the lawsuit only goes back to 2006?

After reading about this lawsuit, I’m curious if you could bring a similar suit against the makers of Ketoprofen!! I suffer with chronic pain and quit opiates due to the hoops we are now made to jump thru. So I had taken Orudis which was a over the counter ketoprofen, it was then taken away, only by prescription..well this year my Dr wrote me the script~well the pharmacists all were, ” it’s on back order, we can’t get it” no matter which pharmacy I went to! Well at this same time several clinics have opened up to do ketoprofen IV infusions!! And insurance won’t cover it! How is it they can get their hands on it but no one can get a script filled?? CROOKS!!
