A $35 million settlement with Cephalon Inc., Teva Pharmaceutical Industries Ltd., Teva Pharmaceuticals USA Inc., and Barr Pharmaceuticals Inc., has been reached in a class action lawsuit involving the price of the prescription drug Provigil.

Provigil and generic versions are primarily prescribed for the treatment of certain sleep disorders, including narcolepsy.

Attorney Generals from 48 states and the District of Columbia filed the lawsuit on behalf of individuals who paid for Provigil or its generic counterpart modafinil.

The lawsuit claims that the defendants engaged in a course of conduct to delay the sale of low-cost generic versions of Provigil in violation of federal and state antitrust laws and consumer protection laws.

The defendants deny these claims and say their conduct was legal.

No one is claiming that Provigil or generic versions of the drug are unsafe or ineffective.

Under the terms of the Provigil antitrust settlement, consumers (except those in California or Louisiana) who purchased Provigil or generic versions from June 24, 2006 through Mar. 31, 2012 may be eligible to receive a distribution from the $35 million settlement fund. This settlement fund is known as the States’ Consumer Fund.

Additionally, if a settlement is reached in a related case: In re: Modafinil Antitrust Litigation, Vista Health Plan Inc. v. Cephalon Inc. et al., a Class Consumer Fund will also be established and the settlement amount from this case will be merged with the States’ Consumer Fund.

California and Louisiana consumers will receive money only from the Class Consumer Fund.

Class Members who wish to exclude themselves or object to the terms of the Provigil class action settlement must do so no later than Apr. 14, 2017. As a Class Member you may choose not to submit a claim. If you choose not to submit a claim, you will not receive any money or benefits from the proposed settlement.

Who’s Eligible

Eligible Class Members include:

“All persons residing in the states of Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, Wyoming and the District of Columbia who purchased and/or paid for Provigil or generic versions of Provigil (modafinil) for consumption by themselves or their families during the period from June 24, 2006 through March 31, 2012.”

You “purchased and/or paid for” if you paid some or all of the cost of the drug. If insurance did not pay for the whole amount of the drug, you are included. Specifically, you purchased and/or paid for Provigil or generic versions of Provigil (modafinil) if you were:

  • An uninsured consumer who paid all of the purchase price of the prescription; or
  • An insured consumer who made a co-payment or other partial out-of-pocket payment, or paid the entire cost because you had not met a deductible amount under your health plan.

Residents of Louisiana and California are not included.

Persons that purchased Provigil or generic versions of Provigil (modafinil) for purposes of resale or made purchases directly from the defendants are not included.

A $35 million settlement fund will be established. Consumers’ recovery will be calculated based on how much you paid for Provigil and generic versions of Provigil (modafinil) from June 24, 2006 through Mar. 31, 2012, compared to the amount paid of all other consumers who file valid and timely Claim Forms.

    I took it but I can’t remember the exact dates of what pharmacy I was using back then. I can narrow it down to about 3. I don’t know how much I paid out of pocket. How would I get this info? Any suggestions?

    I have been on this drug for narcolepsy at least 15 years. My co-pays has changed over the years. I wonder if Walmart or CVS could help with a print- out of my out of pocket expense was?.

      yes! go their website and look for a link to request your records.. do it right away, because it can take a couple weeks to receive it. mine for that time frame was almost $40,000.

    I took it for narcolepsy. Provigil and nuvigil. And it worked well, my insurance decided they didnt want to help pay for it Any more so then they switched it to the generic Modaffino and I got severe nose bleeds from that. Its supposed to be the same thing but a generic brand. WHY woulx ths insurance stop covering some of the cost of a drug that I was on for 10 years and then switch it to a drug that gave me nosebleeds plus i had to take 60 pills a month insreat of 30 the cost was more too almost double. I dont understand how my Insurance company knowns better of what treatment i should take verses a Doctor.Now the lost me completely as I can not afford the cost of my health to be jepordized by the Generic.and the provigil I can not afford the cost of it alone.

    I have taken Provigil or some form of modafinil since the drug has been available in U.S.A. for narcolepsy. My total out of pocket is well in excesses of $65,000.00.

      I know what you mean! mine just for the lawsuit period is almost $40,000, but I live in calif, so I wont get anything!

    I paid WAY more money after March 2012. Thousands more! It was the “generic” modafanil that I paid almost $5000 for out of pocket while my insurance paid just under $8000. I didn’t even fill it every month, I usually went without.

    If I join this class for purchasing between 6/24/06 – 3/3/12 does it exclude me from a future settlement for purchasing between 4/1/12 – 7/28/2016 when the generic form was still monopolized??

    the section “what are my other rights?” at the bottom of the first pg states,

    “If you purchased Provigil and/or modafinil through July 28, 2016, and you do nothing, your rights will be affected. If you do not want to be legally bound by the settlement, you must exclude yourself. If you do not exclude yourself, you will not be able to sue the defendants for any claim relating to the lawsuit.”

    It is confusing. Does this mean joining the class will automatically exclude me from this other pending litigation? it sound like I may get very little, so I don’t want to opt out of a future settlement that is for the time I paid quite a bit more.

    I’ve been on this drug since 2006, what are the side affects??? I took it for chronic fatigue and fibromylgia

      you took it for those issues? Interesting,because my son endures both,but with the added sleep disorder of circadian rhythm disorder….it didn’t help him at all,but I’m wondering if it helped you with the CFS/fibro

        I took it for narcolepsy and have fibro but it didnt do anything its not black labeled for it either

    I had to be on it and my insurance denied it, so I had to pay full price. We did without many things because we couldn’t afford this drug. I filed a claim for the dates they asked for. Does anyone know why there isn’t a settlement for after March 31, 2012 – until now? Thanks

      Probably because modafinil went generic in April 2012.
