Quincy Bioscience has agreed to resolve the claims that it misrepresented its Prevagen products as supporting brain health and helping with memory loss. Under the terms of the settlement, eligible purchasers can recover refunds of up to $70.

The settlement benefits individuals who purchased one or more Prevagen products from a Quincy Bioscience or an authorized retailer between Jan. 1, 2007 and July 21, 2020.

Plaintiffs in the Prevagen brain health class action lawsuit claimed that Quincy Bioscience intentionally misrepresented their products as able to help with brain health and lessen memory loss. These claims were allegedly used to market several Prevagen products such as:

  • Prevagen Regular Strength 30 Count
  • Prevagen Regular Strength Chewables
  • Prevagen Regular Strength 60 Count
  • Prevagen Extra Strength 30 Count
  • Prevagen Extra Strength Chewables
  • Prevagen Extra Strength 60 Count
  • Prevagen Professional Strength

According to the class action lawsuit, the marketing and advertising representations on these products deceived consumers into thinking that their brain health and memory loss would be helped by taking the supplements.

However, plaintiffs say this is untrue. In addition, the class action lawsuit claims consumers were misled by the products and deceived into purchasing them or paying a higher price — causing financial damage.

Quincy Bioscience has not admitted any wrongdoing but has agreed to resolve the claims against them in a settlement.

The Quincy brain health class action settlement provides cash refunds to eligible Class Members. Cash refunds will compensate Class Members for 30% of their purchases, based on Quincy MSRP defined below. Payments are capped at $70 with proof of purchase or $12 without proof of purchase.

The settlement also provides injunctive relief. Under these terms, Quincy Bioscience will stop marketing their products as able to support aging brain health and improve memory loss.

In order to benefit from the settlement, Class Members must file a valid claim form by Oct. 26, 2020. Proof of purchase such as receipts can be included with these claims for a higher payout.

Claim forms can be filed online with or without a Claim ID and PIN. If Class Members wish to fill out a paper claim and mail it in, they can do so by calling or writing the settlement administrator.

The deadline for exclusion and objection from the settlement is Oct. 27, 2020. The final approval hearing for the Prevagen brain health class action settlement is Nov. 17, 2020.

Who’s Eligible

Individuals who purchased one or more Prevagen products from a Quincy Bioscience or an authorized retailer between Jan. 1, 2007 and July 21, 2020.

Potential Award

30% cash refunds of up to $70.

Cash refunds will compensate Class Members for 30% of their purchases, based on Quincy MSRP defined below. Payments are capped at $70 with proof of purchase or $12 without proof of purchase.

The Quincy MSRP shall be defined as:

  • $39.95 for Prevagen Regular Strength 30 Count or Prevagen Regular Strength Chewables;
  • $74.95 for Prevagen Regular Strength 60 Count;
  • $59.95 for Prevagen Extra Strength 30 Count or Prevagen Extra Strength Chewables;
  • $109.95 for Prevagen Extra Strength 60 Count; and
  • $89.95 for Prevagen Professional Strength.
Proof of Purchase

Receipts or other documentation are not required but may entitle Class Members to a higher payout.

    Omg, I know!!! These people drive me crazy with their “add me’s”. Doesn’t matter how many dozen’s of times they are told that that’s not how it works either… There will still be 20 people after that post saying “add me”. Lol

    I took prevagen in2016-2017 it didn’t work for me .after stop taking them I went into the hospital with heart congestion they thought. I had chest pain,blood was high,dizzyness.The doctors really didn’t know what was wrong with me.I was sent to a heart specialist .He said it was stomach acid.Prevagen did nothing for me that it claim it would do,but I did end up in the hospital after taking them.
