Pioneer Credit Recovery Inc. and General Revenue Corporation have agreed to pay $575,000 to settle allegations that the companies violated the Electronic Fund Transfer Act and the Fair Debt Collection Practices Act.
Lead plaintiffs Christopher Globus and Michaelene Dawson filed the FDCPA class action against Pioneer Credit after claiming to be sent a form for automatic withdrawal authorization from the debt collector.
The Pioneer Credit class action lawsuit states that the language in the withdrawal authorization violated both the EFTA and the FDCPA because it limited the rights of consumers to stop payment on a preauthorized electronic fund transfer.
If you were sent a certain form of automatic withdrawal authorization between Feb. 17, 2014 and Dec. 4, 2015, and you may be entitled to payment from this class action settlement.
Pioneer Credit Recovery Inc. and General Revenue Corporation deny these allegations but agreed to settle the class action to avoid the expense, inconvenience and distraction of continued litigation.
Who’s Eligible
Class Members include all individuals who were sent any correspondence from the defendants that included the automatic withdrawal authorization between Feb. 17, 2014 and Dec. 4, 2015.

Oddly I tried to pay Pioneer via online and at the end of the form said “I agree to pay amount stated above” well the total was stated above but not the amount I wanted to pay. Needless to say I didn’t pay anything for fear they would take the entire amount out of my bank. Now I get a call everyday from them. I really never knew I owed because usually in the past my medical insurance paid everything, I was shocked to find I had 600.00 in collection.

PS James, they can garnish your wages/ take your taxes regardless of this lawsuit. You can expect all of that as it appears from what you’ve written, that you are in default, correct?
They were fired or contract with u.s terminated in 2015 for other than honorable tactics so how can they garnish anyone now. Would like to know this can’t find any info
If you qualify financially, hardship programs are available. Ask. These hardship programs take your debt out of default status and then they are regarded as “deferred”. All collection actions stop with a deferment. (ie They can’t take your tax refunds, garnish your wages, etc) But you have to keep up with the paper work, usually every six months, to keep it in a deferred status. As far as not contacting Pioneer Credit Recovery, that is referring to questions about this settlement, you are fine to call about your debt/payment plan/ etc. Ask about the William D. Ford hardship program. That was an option in the past, there may be other options. I haven’t worked for PCR in five years. Things change.
Because of this settlement, it was said on the form that was to me that I can’t contact pioneer but I had previously contacted them before I knew that this collection agencies was being sued. I wanted to contact them about starting a payment play so that they wouldn’t garnish my federal tax. Can they still garnish it being that there in a lawsuit that involves me?
