Walmart has agreed to pay up to $45 million to settle a class action lawsuit against them, alleging that the company wrongfully charged non-discounted sales tax on discounted purchases at their Pennsylvania locations.
Consumers may be able to benefit from a new Walmart settlement if they used a coupon when purchasing a taxable item at a Pennsylvania Walmart from Jun. 8, 2007 through Apr. 15, 2015, received a discount on the taxable item, and were charged sales tax on the original purchase price of the taxable item without accounting for the discount.
Walmart has agreed to pay between $21.5 million and $45 million to settle claims that they violated Pennsylvania state law by failing to deduct the value of coupons before calculating sale tax. Eligible consumers who file a valid claim may be able to receive a gift card valued between $30 and $100. The amount received by each class member will depend on the number of valid claims submitted.
Plaintiff Brian Farneth filed the class action after he says he purchased two cans of shaving cream using a buy one get one coupon, but was charged sales tax on both of the items instead of only one. The Walmart class action was originally filed in a state court, removed to federal court, and removed again to state court after a federal judge determined that a Pennsylvania state court would be better equipped to handle the claims.
Eligible consumers have until Nov. 22, 2018 to submit a claim form online or through the mail, or until Nov. 14, 2018 to opt out of or object to the settlement. The final fairness hearing is scheduled for Nov. 19, 2018, after which the settlement fund will be dispersed.
