Probationers who paid probation fees to Rutherford County, Tenn. or its contractor PCC can now get benefits from a $14.3 million settlement.

The settlement reimburses probation fees paid as early as October 2011 and in some cases earlier.

Named plaintiffs Cindy Rodriguez, Steven Gibbs, Paula Pullum, Yolanda Carney, Jacqueline Brinkley, Curtis Johnson, and Fred Robinson brought this Rutherford County class action lawsuit in October 2015, naming as defendants Rutherford County, Tenn., Providence Community Corrections (now known as Pathways Community Corrections, or PCC), and five individual defendants associated with PCC.

For several years, PCC contracted with Rutherford County to provide probation officers to manage the county’s probation system for non-felony cases.

The plaintiffs allege Rutherford County and PCC colluded illegally to overcharge probationers for fines, fees, costs and surcharges related to their probation. In lieu of getting paid by the county, PCC allegedly profited by assessing charges to probationers.

Many of the probationers affected by the alleged scheme were low-income persons vulnerable to getting caught in a cycle of debt. Some probationers allegedly went to jail because they could not pay the fees assessed by PCC.

Plaintiffs claim the arrangement between PCC and Rutherford County violates the federal Racketeer Influenced and Corrupt Organizations Act, other federal and Tennessee statutes, and several provisions of the U.S. Constitution.

Under terms of the Rutherford County class action settlement, Class Members can receive reimbursement for 125 percent of qualifying probation fees paid either to PCC or to Rutherford County. Some Class Members may receive an additional $50 for each month of their probation.

Class Members must submit a claim to get benefits. Claims are being accepted online or by mail, with or without a Notice ID.

Class Members can exclude themselves from the settlement or object to its terms by submitting a written request no later than April 27, 2018.

PCC and Rutherford County continue to deny the plaintiffs’ claims, and the settlement does not require them to admit any liability. The defendants say they agreed to the settlement only to avoid the expense, inconvenience and risk of continued litigation.

Who’s Eligible

Settlement Class Members include all persons who at any time from Oct. 1, 2011 through Oct. 5, 2017 “incurred court-imposed financial obligations arising from a traffic or misdemeanor case in Rutherford County General Sessions or Circuit Court, and were supervised on probation in that case by PCC or Rutherford County’s Probation Department.”

Potential Award

Varies.

Payment amounts will vary according to the Class Member’s dates and length of probation. According to the settlement agreement:

  • Class Members whose PCC probation ended prior to Oct. 1, 1014 can get payment for 125 percent of the qualifying fees paid to PCC beginning Oct. 1, 2011. These Class Members can get compensation for fees paid prior Oct. 1, 2011 if they continued to pay fees for the same offense on or after that date.
  • Class Members who were on probation with PCC on or after Oct. 1, 2014 can get $50 for each month that they were on PCC-supervised probation, plus 125 percent of the amount they paid in PCC fees. These Class Members can get compensation for fees paid prior Oct. 1, 2011 if they continued to pay fees for the same offense on or after that date.
  • Class Members who were on probation with Rutherford County’s Probation Department in or after March 2016 and either (a) were on supervised probation solely for the payment of court-imposed financial obligations or (b) would have been removed from supervised probation but for the payment of such an obligation can get $50 for each month they were on supervised probation from March 2016 through Jan. 2, 2018 (the date of preliminary settlement approval), plus 125 percent of the probation fees they paid to Rutherford County’s Probation Department from March 2016 through Jan. 2, 2018.

Under the settlement agreement’s injunctive relief provisions, Class Members who still owe outstanding probation fees related to a Rutherford County courts probation case and earn below 125 percent of the federal poverty line can petition to have those fees waived.

Proof of Purchase

The Claim Form asks Class Members to provide their contact information, the approximate dates they were on probation, and their Rutherford County case number. No additional documentation is requested.

    This not only happened to myself but also to my husband, we’ve both filed the appropriate paperwork and are just trying to find out what the next step is. I find it appalling that this was allowed to happen to so many people. Does anyone have any information on where they are in the proceedings and when we should be contacted?

    Well im not from Rutherford County but I can honestly say that isn’t the only county that this kind of thing happens in!! I live in NC and was put on house arrest back in 2011. My parents were told by my house arrest officer that they had 2 pay $50 a month and they were VERY LOW INCOME! When my mom came to pay the very last payment at the courthouse she saw the officer above everybody in the house arrest division and he told her that she should not have had 2 pay the $50 a month fee. Not only that but later when I was caught with my own medicine but just didn’t have it in the bottle (bc it was one pill& I didn’t feel like carrying the huge bottle Walgreens put em in) I had 2 take a court appointed attorney who instead of getting the charge dismissed (bc I brought my prescription proof 2 court but he thought it wiser to take the charge and be on probation bc the judge said she’d waive all court fees & that there was “no fine associated”with the charge so all id have 2 pay was his attorney fee which he said was $180 and when I got that paid off then I would be able to get off probation) well when I went to see my probation officer the 1st mt she said she couldnt tell me yet how much I owed but then the 2nd month when I got the bill it had court fees included so that $180 actually ended up being over $1300!! Not only that but after I paid that in full EARLY and went 2 court to get off probation the judge said he “wasn’t quite ready 2 let me go” & added more fees, which along with the $40 a month probation charge ended up costing me a lil over $400 sumthn more! I thought there was someone who typed out what was said in court rooms, so there should have been proof that the original judge who gave me the terms of my probation had WAIVED court fees but I had no way to prove it & nobody seemed to believe me! What made me think of this is how this class action said that the probationers were overcharged for their fines, fees, costs and surcharges related to their probation & I remember looking at some of the receipts and seeing the breakdown and thinking “this makes no sense whatsoever”..not only was I not supposed 2 have to pay any of those things but the way they broke all the fines, fees, costs and surcharges down proved to make even less sense bc a lot of it didn’t even pertain to me, like things dealing with jail when I didn’t even go 2 jail. Anyway, I wish I knew how to go about starting something like this in my county bc it’s obvious to me that there’s the same type of fishy practices here as what happened in this case.

    What kills me is the probation officer who did this to my daughter is still there her name is Kelly Haley and her name is all in this lawsuit document why is she still allowed to work for RUTHERFORD County

    I have them red handed pulling this on my daughter. In January of 2017 they said she owed 1183.50 she paid 300 that day so it shows balance of 783.50 we still have all of it then in February of 2017 the very next month her probation officer said she owed 1128.50 she paid another 450 and Then showed her balance at 678.50. They Pocketed 345 dollars in a month and thought they would never get caught I have the paperwork

    Its messed up how the system works. I was one of the people who were kept on probation until my court fines were paid off. I’m so glad the ones that knew this was illegal stood up and did something. Rutherford county knew what they were doing!! That system is so corrupt.

    Wow, I feel like the people who were involved in this “scam” should be put on “probation”. The court system is always taking advantage of low income policies. I wish they were facing jail time.
