Path text message lawsuit

The social networking service, Path Inc., has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system, or artificial or prerecorded voice, to contact consumers on their cell phones without their consent.

If you received a text message on a cell phone from or on behalf of Path Inc. between March 28, 2009 and March 28, 2013, you may be eligible for benefits from the class action settlement.

Plaintiff Kevin Sterk initially filed the TCPA class action lawsuit against Path Inc. in May 2015, accusing the company of violating the Telephone Consumer Protection Act by contacting his cell phone without his consent, thereby invading his privacy.

Kevin alleges Path sent unsolicited text messages to cellular telephones using an automatic telephone dialing system for promotional purposes. The text message invited consumers to download Path’s Mobile Application and sign up for its social networking service.

The lawsuit alleges Path violated the TCPA because consumers did not agree to receive these text messages.

Path denies these allegations but agreed to settle the TCPA class action lawsuit to avoid the time, risk and expense of continued litigation.

Under the terms of the class action settlement, Path will offer a total of $5 million in payment via a settlement fund to Class Members who submit timely and valid claims.

Who’s Eligible

Class Members of the Path Inc. TCPA settlement include all persons who received a text message without their consent from Path short code 59730 that contained a website URL where the recipient could download the Path Mobile Application between March 28, 2009 and March 28, 2013.

Potential Award

Up to $70 depending on the total number of valid claims submitted.

Path Inc. has agreed to create a $5 million Settlement Fund. Class Members who file valid claims will receive an estimated $70 payment, but if the number of valid claims is high, then the amount of individual payments may decrease.

The Settlement Fund will be used to pay all valid claims, costs of administering the Settlement, attorneys’ fees, and incentive payment to the Class Representative.

Payment will be mailed via check to Class Members who file timely and valid claims.

    Looks like the court settled the case on September 29th, 2015. About $1.7 million will go to settle the case. I wonder how much we will get and when they will send out the checks?
