UPDATE:

  • On May 24, 2017, three additional defendants have agreed to settle this class action lawsuit, bringing the total settlement fund up to $180 million.
  • Class Members now have until Oct. 30, 2017, to file a claim, which can be done online in just a few minutes.

A group of electronics companies have agreed to pay a total of $180 million to settle a class action lawsuit that accused them of engaging in a conspiracy to fix the prices of optical disk drives. These settlements affect indirect purchasers of optical disk drives.

Optical disk drives are devices that allow data to be read from and/or written to optical disks, such as DVDs, CDs and other computer software storage. Optical disk drives are included in a variety of consumer electronic devices, including desktop and laptop computers.

This optical disk drive antitrust class action lawsuit includes a number of consolidated cases that were filed against electronic companies after the U.S. Department of Justice announced in 2009 that it was conducting a criminal investigation into the optical disk drive industry. The optical disk drive class action lawsuits were consolidated in 2010.

On July 21, 2016, a California federal judge approved $124.5 million worth of settlements in the case with Sony, Hitachi-LG Data Storage, Panasonic Corp., and NEC Corp. In March 2017, PLDS, Pioneer and TEAC agreed to pay an additional $55.5 million to resolve the price-fixing claims against them, bringing the total settlement to $180 million.

Consumers covered by the optical disk drive settlements include consumers in 23 states and the District of Columbia who bought optical disk drives from April 2003 to December 2008.

Several named defendants remain in this class action lawsuit including: BenQ Corporation, BenQ America Corp., Samsung Electronics Co., Ltd., Toshiba Corp., Toshiba Samsung Storage Technology Corp., Toshiba Samsung Storage Technology Corp. Korea, and Quanta Storage Inc. A trial date of Feb. 12, 2018 has been set for these remaining electronics companies.

Class Members who want to opt out of the settlement or ask to be excluded from its terms, must do so by July 14, 2017.

Who’s Eligible

Class Members of the indirect purchaser optical disk drive settlement include any one who was a resident of Arizona, California, District of Columbia, Florida, Hawaii, Kansas, Maine, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, Oregon, Tennessee, Utah, Vermont, West Virginia, or Wisconsin and who, between April 1, 2003 and Dec. 31, 2008, purchased (for their own use and not for resale) one or more of the following products manufactured by one or more of the defendants or their alleged coconspirators:

• A computer with an internal optical disk drive;
• A stand-alone optical disk drive designed for internal use in computers; or
• An optical disk drive designed to be attached externally to a computer.

NOTE: Purchases of Panasonic-brand computers are not covered by this class action settlement.

Potential Award

$10 per drive (estimated).

The settlement fund will be distributed among Class Members on a pro rata basis. The actual amount each consumer receives will be based on how many ODDs purchased by the Class Member during the Class period and the total number of claims filed. The Claim Administrator estimates this will amount to $10 per drive, but the actual payout could be more or less depending on these factors.

Proof of Purchase

Class Members must file a Claim Form no later than Oct. 30, 2017 as well as provide the total number of products containing an ODD purchased between Apr. 1, 2003 through Dec. 31, 2008.

“Additionally, if you previously filed a claim on the initial settlements with Panasonic, NEC, Sony and HLDS, you do not need to file a new claim now and your previously filed claim will automatically be counted toward the new settlements with PLDS, Pioneer and TEAC, as well as any future settlements that may be reached with any of the remaining defendants in the case, unless you specifically exclude yourself from one or more of those new settlements.”

      1. Khrysse says:

Payments for this second round will only be Flat $5 + $0.86 per drive. So for most it is far from the $133.93 had it been equally shared. Expect payment between today and Nov 4th.

        1. Phil says:

Where did you read $5 plus .86 per drive at?

        2. Khrysse F says:

It’s on the claim site, under FAQ, at the top.

  2. Still waiting says:

An update on the matter. The administrator informed me that the check most likely would be mailed this week. This means another 1-2 weeks in waiting. Good luck to us all!

    1. MR. SEAN STILL NO CHECKS says:

Was this after the fact that they said they’ve mailed them back on the 17th? Did they say they didn’t mail them? Or what’s going on with the checks they said they mailed? I’m so confused and this has caused me lots of stress in the last 2 weeks, seriously, the counsel is wrong for lying to us!

      1. Still waiting says:

The admin never told me the date they would mail. They would only say in 1-2 weeks each and every time I contacted them. And this has been going on since August 15.

        1. Sean to still waiting says:

Thank you for your prompt reply, and yes, the admin would also tell me the exact same, but I did get a date that they’d send it out, and it was the 17th of this month, so let’s hope there was an error; because it is indeed a third party called ( EPIQ) that’s sending the checks! So let’s pray we both receive our share by this time
Next 2 weeks! And please keep me updated as I will do the same’ thansk still waiting ‘

          1. Still waiting says:

Sure. But don’t take it so close to your heart. The best part is that these checks were approved, and sooner or later they will reach their destination. At least, you know, that some funds are heading your way :))

    2. Still Waiting to Sean says:

Sean, as promised. Today, September 12, I got my check. The amount is much less than anticipated-very disappointed.

  3. Sean says:

Hi Ke, as of today, I have not yet received my check again’ it’s been over a week’ if you don’t mind’ what date did they send you your check on?

    1. Ke says:

The check is dated for 08/17/2022, and the postmark is dated for August 17, 2022.
I hope you get yours soon

      1. Sean says:

Thank you Ke, and I know these checks mean a lot to us! I sure hope to get mine today’ and the 17th was indeed the day they said they’re mailing mine as well! Let’s hope today it comes

    2. Still waiting says:

İ have the same situation. The admin promised to mail the check 2 weeks ago. Now, they do not even reply anymore.

      1. Sean’s pissed says:

As of 08/26/2022 I still have not received a check supposedly sent out on 08/17/2022 the stupid class admin controlling the email seems not to know shit

      2. Big bummer says:

Same here! Mailed out on the 17th and today is the 26th and still not here! Not to mention the check is supposedly only coming from a state away

  4. Sean’s nervous Again! says:

So I got word, that my specific check was mailed out on the 17th! And today is now the 22nd and I have nothing in the mail whatsoever! It’s nearly going on a week and I’m nervous! Anyone have any checks they received? Mine is for the first settlement round! The second round will take place in mid – September
