Dairy Farmers of America Inc. and Dairy Marketing Services LLC have agreed to pay $50 million to settle a class action lawsuit that accused the companies of price-fixing the cost of milk.
This approved settlement comes after six years of pending litigation and two previous settlement rejections.
U.S. District Judge Christina Reiss approved the $50 million class action settlement, that should award dairy farmers $4,000 each, saying that the dollar amount was “modest.”
The dairy class action settlement also allows farmers to exclude themselves from this litigation and pursue individual lawsuits if they want.
In 2014, Dairy Famers of America reached a proposed settlement but Judge Reiss ultimately refused to grant final approval.
The parties tried again in 2015 to settle but Judge Reiss denied that settlement because she didn’t believe it to be fair. The latest revision, which includes the opt-out provision, was granted approval by Judge Reiss last month.
Dairy farmers who want to opt-out or object to the settlement must do so by Apr. 22, 2016.
UPDATE: On June 7, 2016, the court granted the settlement final approval. However, appeals have been filed. Claims will not be paid until all appeals are resolved. We appreciate your ongoing patience. Top Class Actions will continue to provide updates as we learn more.
Who’s Eligible
Northeast Dairy Farmers who produced and pooled Raw Grade A Milk between Jan. 1, 2002 until Dec. 31, 2014 may be eligible to receive a payment from this class action settlement.
Potential Award
$4,000
According to the settlement administrator, Class Members are expected to receive $4,000 but depending on the number of valid claims you could receive more or less.
Proof of Purchase
N/A
Class Members who submitted a Claim Form last year in the prior DFA/DMS settlement and want to receive payment from this settlement don’t need to submit a new claim. If you didn’t submit a Claim Form in the previous settlement, you must submit one no later than Apr. 29, 2016.
