North Shore Pain Management has set aside $200,000 to settle a class action lawsuit that claimed the company and Resolve I.T. Inc. did not adequately protect personal information. 

The class includes any person who received a notification that was sent by or on behalf of North Shore Pain Management regarding the data security incident that occurred in April 2020.

The lawsuit claims that Resolve I.T. Inc. was the victim of a ransomware attack on or about April 16, 2020.

During ransomware attacks, cybercriminals essentially steal data and demand large payments from victims to recover the data. 

North Shore Pain Management is a referral-based pain clinic in Beverly, Massachusetts.

The data stolen in the North Shore Pain Management data breach included personal and protected health information belonging to North Shore patients. The breach exposed the information of about 12,000 patients, according to the Salem News. A notice of the breach was sent to patients in June. 

The Salem News reported those affected had made payments to North Shore between Aug. 1, 2014, to April 16, 2020.

Both North Shore Pain Management and Resolve I.T. maintain they had appropriate defenses put in place but decided to settle to avoid ongoing legal expenses and risks. 

North Shore and Resolve I.T. deny wrongdoing or violating laws.

The settlement includes several benefits for class members.

Resolve I.T. has made up to $200,000 available to class members for unreimbursed expenses and/or lost time relating to the data breach.

Individuals in the class will be eligible to enroll, at no cost, in credit-monitoring services for 36 months. 

The settlement terms also provide for reimbursement of lost time or documented economic losses, up to $150 per class member, as well as reimbursement of extraordinary economic losses, up to $1,500 per class member, that are related to the data breach.

Alternatively, class members may elect to receive a payment of up to $25 in lieu of the credit monitoring and reimbursement of economic losses. 

If total claims exceed $200,000, the payments will be reduced pro rata, meaning the payment could be less than $25.

Class members have until Dec. 14, 2022, to object to the settlement. 

The final approval hearing will be held Jan. 10, 2023.

The deadline for activating the credit monitoring product and submitting a reimbursement form in the North Shore Pain Management lawsuit settlement is Jan. 13, 2023. Those who do nothing will not receive any benefits or reimbursement.
