Details:Â The Nexium settlement resolves a long-running class action lawsuit (Commonwealth Care Alliance, et al. v. AstraZeneca Pharmaceuticals L.P., et al.) that accuses AstraZeneca of deceptively marketing Nexium as superior to its other heartburn drug, Prilosec, and its generic version, omeprazole, in order to get consumers to purchase the more expensive Nexium.

AstraZeneca denies the allegations but has agreed to establish a $20 million class action lawsuit settlement to resolve the litigation.

Class Members of the Nexium class action settlement include any person or entity who, from March 1, 2001 through February 6, 2013:

- Purchased Nexium in or from Massachusetts, or
- Reimbursed or paid for Nexium dispensed in Massachusetts, or
- Reimbursed or paid for Nexium purchased by mail order from Massachusetts

If the settlement is granted final approval, Consumer Class Members will receive 43.38% of the net fund, and Third-Party Payors will receive 56.62% of the net fund.

If you are a consumer, you have two payment options: a flat-rate payment of $25 or a full refund of the amount you paid for Nexium. Uninsured consumers who paid for Nexium with cash can receive $97 per prescription or 54% of the total amount they paid. Insured consumers who paid for Nexium with a co-pay or coinsurance can receive $17.50 per prescription or 61% of the amount paid.

Third-Party Payors will receive an estimated 44.5% reimbursement of the amount they paid.

The only way to receive a cash award from the Nexium class action settlement is to submit a valid Claim Form postmarked, faxed, emailed or submitted online by August 30, 2013.

anyone have any updates on this settlement or when distribution will occur? i mean, Final Approval was back in the end of July! we probably wont even get 10% of what we claimed……
Term rejection or auto rejection also means that settlement gets paid to many consumers however those they have tagged will not get answer, will never know they were rejected and if did get letter to correct it wikll be rejected by some group leader or expert in seattle washington called project leader or team leader who is also been well groomed to continue to reject claims of tagged people period. Low life policy , how low these people can go. Its shame on lawyers to retain Garden City group to handle claims for insane rejections.
Garden City Group has tagged many first and last names and addresses as tagged claims. Meaning no matter what you file. Not required receipts claims, required receipt claims, medical receipts, brokers receipts for trades on securities frauds claims, no matter what each and every claim tagged people file with proofs they are just rejecting them and their families period. Low life technique, violating human rights, true claims with proofs and still rejecting is called Garden City Group settlement administrator. Sounds like does not matter you are right on anything you will be Torted by Garden city Group ..We lost six figures of money in Washington Mutual fraud securities claim and sent brokers statement, trade receipts we were rejected along with ACT mouthwash, Yopla yoogurt, Skechers, Bayers vitamins,Vita CoCo, Career Education, and many many others claims even with receipts. Because they have tagged our family names and addresses.Punishing innocent families for noreason and violating human rights laws every day is Garden city Group .
Did anyone get rejection letters? If so, can you let us know what they you got them? Was there a date that it had to be returned back to GCG?
Ryan, I was denied with two receipts as well.
As I said earlier submitted receipt with all required datas for claim met still received rejection on NEXIUM because someone at GCG has tagged my family for not allowing any claims. So far I have been rejected by GCG on new balance, skechers, Yo Pl yogurt, ACT mouthwash and Bayer and now huge amount on nexium for no good reason just they have targeted and just rejected even with receipts. GCG is discriminating people on names and races illegally and is out of control.
People dont you think how discriminatory this is as its allowed with massachusetts connections only. Second the most dangerous , abusive, unqualified company on face of this earth Garden City Group is handling this to settle meaning they will reject thousands without any merrit wheather you submit pharmacy doctor or any healthcare receipt because they will call to check on your personal life to the bottom only to reject your claimsand pocket millions to them selves.
