New Dominion LLC has agreed to a $5.9 million class action lawsuit settlement resolving claims that it was responsible for earthquakes that occurred and caused damage near Prague, Oklahoma, between Nov. 5 and 8, 2011.
The settlement class consists of any Oklahoma citizens who owned a business or residential real estate property in Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee and Creek counties between Nov. 5 and 8, 2011, and who suffered damages to the properties as a result of the earthquakes.
The plaintiff in the class action lawsuit claims nearby oil and gas wastewater disposal well operations belonging to New Dominion caused three earthquakes on Nov. 5, 6 and 8, 2011, that damaged properties in and around Prague, Oklahoma.Â
New Dominion is an independent exploration and production company that harvests clean natural gas and natural gas liquids from more than 400 wells in Oklahoma.
Earlier this year, several oil companies agreed to pay $7.5 million to resolve claims that their wastewater wells caused quakes in Oklahoma in 2016 that led to property damage.
New Dominion denies any accusations of wrongdoing but has agreed to the settlement to resolve the class action lawsuit.
Class members in the Oklahoma earthquake damage settlement can receive a cash payment from the settlement by submitting a claim form online or mailing it to the address on the form.Â
Along with the claim form, the class member must provide evidence of the claimant’s damages and make a claim for a sum certain not to exceed the amount of the provided repairs estimates and bills in relation to earthquake property damage; this can include photographs, repair bills or repair estimates.Â
Each claimant will receive a proportionate payment based on their respective approved claim. If money remains in the settlement fund, the remaining balance will be distributed proportionately. If the total amount of claims exceeds the fund amount, the net proceeds willbe distributed proportionately on a pro rata basis.
The deadline to opt out of or object to the settlement has passed.Â
A final fairness hearing in the Oklahoma earthquake damage class action lawsuit settlement took place Sept. 25, 2023.
Claim forms must be submitted by Jan. 13, 2024.
Who’s Eligible
Any Oklahoma citizens who owned a business or residential real estate property in Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee and Creek counties between Nov. 5 and 8, 2011, and who suffered damages to the properties as a result of the earthquakes
