Details:  The New Balance settlement will resolve a class action lawsuit, entitled Carey v. New Balance Athletic Shoe Company, Inc., that alleges New Balance falsely advertised the health benefits of wearing its True Balance toning shoes to consumers. According to the class action lawsuit, claims that the shoes could burn up to 10-percent more calories with every step, create 29-percent more muscle activation compared to regular walking shoes, and that these figures were backed by scientific evidence simply were not true. The lawsuit further alleged that the shoes may actually lead to injury, “a fact which New Balance deceptively omits from its advertising.”

New Balance denies any wrongdoing, but has agreed to establish a $2.3 million class action lawsuit settlement fund to reimburse consumers in order resolve the litigation.

Class Members of the New Balance toning shoe class action settlement include all persons or entities that bought the following toning shoes from New Balance U.S. retailers, New Balance Stores, shopnewbalance.com, joesnewbalanceoutlet.com, New Balance Outlets, or other third-party retailers from January 1, 2010 through August 29, 2012:

Class Members who submit a valid claim form by the deadline of February 25, 2013 will receive a pro-rated share of the $2.3 million New Balance class action settlement. If the total value of all approved claims submitted by Class Members is less than the amount of money available to pay claims, each eligible Class Member’s award will be increased on a pro-rata basis to a maximum of $100. Class Members may submit more than one claim if they purchased more than one pair of New Balance toning shoes.

    Will, I’m with you! Do they really expect us to keep receipts for years, and they when we don’t have them, deny us what should be ours instead of theirs? Start the class action, I’m second in line

    Wow, this is interesting…many of u in the feed are saying they have sent you letters asking for proof of purchase. I haven’t gotten anything like that, and it wasn’t mentioned when I called in this morning for an update. Still no word on when payment will be received, but I’m thinking perhaps we should file a class action against the attorneys, particularly in this suit. I notice that this firm in particular is making a fortune taking on class actions and winning them. Huge payments consisting of millions while the consumer gets pennies on the dollar or in some cases nothing at all. Another thing that could be a possibility when dealing with these greedy liars (lawyers) would be to write a formal complaint to the bar association in their area. Lawyers take a ethics oath and are suppose to follow it which rarely happens as you can see. I’m not sure if its even worth the energy expended to go that far, but than again, I suspect the lawyers don’t expect any of us consumers to do a damn thing but shut up sit back and wait on their call. Truth, we only have power to stop this foolishness if we do something about, take a stand. If not, do what the lawyers expect you to do stfu and wait till they tell you otherwise.

    I responded to post back n march n stated that i didn’t receive a letter still n its may n still waiting on a check so idk what the story is.

    I never received a verification letter requesting a receipt. I thought if the claim was less than $200 you would not need to send then a receipt. I had purchased 4 pairs, myself, 2 daughters and my sister, but didn’t have receipts of course. Who keeps them once you have given the item to someone and it fits?!?! So my claim was under the $200 so hopefully I will see a little of it at least. Hope everyone else gets treated fairly with this. I will post when I receive a check, if I get one that is!

    I called and was told that checks would be issued the end of April, and that they should be received within two weeks. She also stated if you received a verification letter and did not respond they would either deny you or reduce the amount of your claim. You will not be notified either way, you will get a check or you won’t according to the representative.

    I received verification app over a month ago,i filled it out and sent in my receipt and still have heard or received payment..what give?

    Just called and spoke to a gentleman at 3:39 cst, he stated they are doing the final audit of all claims, but they have no date as of yet. Not sure what SEAN is talking about.

    Called today and the guy said,unless you received a verification in the mail and sent it back in with your receipts you will not be getting a check.
