Navy-Federal-CU

Navy Federal Credit Union has agreed to settle a class action lawsuit alleging it used an automatic telephone dialing system to call cell phones without the prior express consent of the recipient, in violation of the Telephone Consumer Protection Act (TCPA).

If you received one or more phone calls from Navy Federal Credit Union and you did not provide prior express consent to receive these calls, you may be entitled to a payment of up to $1,500 from the TCPA class action settlement.

Plaintiff Ronald Munday alleges that Navy Federal Credit Union (NFCU) called his cell phone in search of someone else, and continued to call him even though he informed NFCU that it was calling the wrong cell phone number. He says that, because he never gave his consent to be called by NFCU, the credit union violated the TCPA.

The Telephone Consumer Protection Act is a federal law that regulates the use of automatic telephone dialing systems to make calls to a cellular telephone, absent an emergency or the prior express consent of the call recipient.

The Federal Communication Commission has recognized that automated telephone calls are a greater nuisance and invasion of privacy than calls made by a live solicitor. The FCC also recognizes that wireless customers may be charged for incoming calls, causing consumers to potentially suffer a financial injury on top of the nuisance.

NFCU has denied any wrongdoing but agreed to pay $2.75 million to settle the TCPA class action lawsuit and avoid the expense and uncertainty of ongoing litigation.

If you would like exclude yourself from or object to the Navy Federal Credit Union settlement, you must do so no later than Jan. 18, 2017.

Who’s Eligible

  2. MzUnderstood says:

This settlement probably won’t pay out until June barring any appeals.

  3. Mitchel says:

    Anyone received a check yet?

  4. MzUnderstood says:

I too got a card stating my number wasn’t on their list of valid numbers called wow. I hope that card was generated in error.

    1. Lisa says:

      Hello,

Do you mind me asking?! When did you receive that card?

      1. MzUnderstood says:

1 week prior to me writing that statement.

  5. Java says:

Got a postcard too from the NF stating my cellular phone number is invalid. Listen to this put your same phone number on the post card and send the post card back. I have three cellular phone numbers, and the claim number that NFCU SENT!!! AND WHEN YOU ASK YOUR PHONE CARRIER LIKE METROPCS THEY DO NOT GIVE TEXT MESSAGE HISTORY REPORTS. Duhh isn’t San Diego, CA a NAVY PORT?

  6. MEL says:

GOT A CARD ASKING TO PROVIDE ANOTHER PHONE NUMBER CAUSE THE ONE I PROVIDED WAS NOT FOUND.

  7. Mr. Navy Federal says:

Got a denial letter today, said my number wasn’t on the list. I guess I just imagined the navy federal robo calls… Looks like I may have to sue on my own. Sigh.

    1. A navy says:

      Anyone else hear anything???

    2. Unhappy Marine says:

I recieved the same letter yesterday, I find it quite odd considering I remember the robo calls in question, and the class council reached out to me initially informing me that I had recieved the calls regarding the law suit. Im no lawyer, but Im assuming they are looking to save as much money for themselves by DQ’ing people who’s CURRENT cell numbers aren’t listed in the lawsuit and making them provide their PREVIOUS cell numbers to qualify for payment. Being an active duty Marine at the time and deploying multiple times to combat during the date range NFCU was making the calls, I changed my number 3 or 4 times with different carriers, which I’m sure is the case with a good amount of other people. Now I’m struggling to find these numbers to recieve the payment that is rightfully mine. Such bullsh*t.

      1. Java says:

I found mine on Experian Credit Report.
