The settlement resolves a TCPA class action lawsuit that accused Navy Federal Credit Union of violating the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system to call cell phones without the prior express consent of the recipient.
Plaintiff Ronald Munday says he received calls on his cell phone from Navy Federal Credit Union in search for someone else. According to the TCPA class action lawsuit, he continued receiving these calls even after he notified Navy Federal Credit Union that it was calling the wrong phone number.
Munday maintains he never provided his consent to receive calls from Navy Federal Credit Union and therefore, the calls violated the TCPA.
The Telephone Consumer Protection Act was enacted by Congress in 1991 to protect consumers from unwanted communications from telemarketers and other solicitors. The TCPA prohibits companies from engaging in certain conduct, such as making robocalls without the prior express consent of the recipient, sending unsolicited text messages, not providing an option to opt out of the communications, contacting consumers who do not have an established business relationship with the company, and other TCPA violations.
Companies that engage in conduct prohibited by the TCPA may face penalties of up to $1,500 per violation.
Class Members of the Navy Federal Credit Union TCPA settlement include: “All persons whom Navy Federal called on their cellular telephone number using an automatic telephone dialing system between October 9, 2011 through September 15, 2016 where the result of that call was that Navy Federal coded the number as a ‘wrong number’ in its records based on information provided by the call recipient.”
Under the terms of the Navy Federal class action settlement, Class Members were entitled to claim up to $1,500, depending on the total number of timely and valid claims submitted.
The deadline to file a claim for the Navy Federal class action settlement passed on Jan. 18, 2017. The TCPA settlement was granted final approval on July 14, 2017.
