Nasal Ease class action settlement

The manufacturer of Nasal Ease nasal spray has reached a class action settlement over claims it falsely advertised that Nasal Ease temporarily relieves allergy symptoms. If you purchased Nasal Ease in the United States between April 1, 2010, and Feb. 25, 2014, you may be eligible to claim a full refund of your purchase with proof of purchase or up to $15 cash without a receipt.

The Nasal Ease settlement resolves a class action lawsuit (Hoover v. Hi-Tech Pharmacal Co. Inc.) that alleges Nasal Ease was advertised as being able to relieve allergy symptoms such as sneezing, sinus congestion and runny nose. Plaintiffs in the class action lawsuit contend that Nasal Ease’s ingredients have never been scientifically proven to be able to treat allergies or their symptoms, and therefore Hi-Tech’s advertising statement were false and misleading.

Hi-Tech denies the allegations but has agreed to set up a class action settlement fund to compensate consumers and resolve the litigation. The class action settlement was preliminarily approved Sept. 27, 2013. A Final Fairness Hearing is set for March 24, 2014. Claims will not be paid until the settlement is Effective and all appeals are resolved.

Who’s Eligible

If you purchased Nasal Ease nasal spray in the United States between April 1, 2010, and Feb. 25, 2014, you can claim a cash refund from the class action settlement.

Potential Award

You may be eligible to claim a full refund of your purchase with proof of purchase or up to $15 cash without a receipt.

Proof of Purchase

Claims submitted with proof of purchase in the form of a receipt will entitle you to a full refund of the amount(s) shown on the receipt. If you don’t have proof of purchase but swear under penalty of perjury that you purchased Nasal Ease during the timeframe listed above you may submit a claim for $5 per product with cap of $15 per household.

    KLCOOK@live.com I am not sure about CPT. Garden city group from Dublin and Seattle, also Rust from Minnesota uses database system…Once you file a claim you are in there for future too. Garden city group puts people on shit list meaning if they have more than one person on same address ,all of you go on shit list. After that you or anyone from that address file a claim or 1000 claims they will reject you all or never answer you and no payment for your life weather you have proof and papers to prove does not mean any thing. Garden city Group is the most dangerous settlement administrator out there. We have heard from 100 plus families that Garden city group either rejected or never answered their every member of the family claim they have filed over 30 claims and all with 0 payment. No answer or reject. Innocent people gets boot for no fault at all. We hope someone takes them to court and shut their operations permanently..

    I spoke to someone yesterday. They stated that my claim had been received and it was in the processing stage. No date though when the checks would be mailed.

    I contacted them via email to update address since moving in March. I filed 11/07/2013 here: http://www.nasaleasesettlement.com/claimform.aspx

    This is their response:

    “Your address has been updated. However, we do not have a claim on file for you. The deadline to submit a claim was February 25, 2014”

    If they don’t have a claim on file for me then how can they update my address??

    I would email them to make sure you don’t end up getting the same response I just got. I did file on 11/07/2013.
