my pillow class action

A settlement has been reached in a class action lawsuit challenging buy one get one free (BOGO) promotions and other MyPillow advertisements, packaging and sales practices.

If you purchased one or more MyPillow products directly from My Pillow Inc. between April 26, 2012 and Sept. 25, 2017, you may be entitled to payment from the MyPillow class action settlement.

The MyPillow class action lawsuit challenged the appropriateness of the marketing, packaging and sale of MyPillow products, including health claims about the product, BOGO promotions, and the use of third party endorsements and logos.

Several similar MyPillow class action lawsuits have also been filed and will be resolved by this proposed settlement should the agreement become finalized.

MyPillow denies the allegations but agreed to settle the BOGO class action lawsuits to avoid the burden and expense of ongoing litigation. The MyPillow class action settlement was preliminarily approved on Sept. 25, 2017.

Class Members who would like to opt out of or object to the MyPillow settlement must do so no later than Jan. 23, 2018.

NOTE: This MyPillow settlement extends the Claim Form deadline and incorporates the claims from other MyPillow class action lawsuits. If you previously filed a claim for the Amari v. My Pillow Inc. class action settlement, you do not need to file a new claim to be eligible for compensation.

Who’s Eligible

Class Members of the MyPillow settlement include anyone who meets either of the following descriptions:

  • Non-Direct Purchaser Subclass: Includes anyone who purchased certain MyPillow products in the United States from a source other than MyPillow between April 26, 2012 and Oct. 13, 2016.
  • Direct Purchaser Subclass: Includes anyone who purchased certain MyPillow products in the United States directly from My Pillow Inc. between April 26, 2012 and Sept. 25, 2017.

The MyPillow products covered by the class action settlement include any products bearing the labeled name MyPillow that are marketed and/or distributed by My Pillow Inc.

Potential Award

Up to $24.

Direct purchaser subclass members may file a claim for $6 per MyPillow they purchased, up to four MyPillow products. Claimants are entitled to receive one of the following cash payments, whichever is higher:

  • If you purchased one or more covered products directly from My Pillow Inc., you are entitled to a cash payment of $6.
  • If you acquired two MyPillow products pursuant to a BOGO offer, you are entitled to a cash payment of $6 per pillow (up to $12).
  • If you acquired four or more MyPillow products pursuant to a BOGO offer as part of your initial purchase from My Pillow Inc., you are entitled to a cash payment of $6 per pillow (up to $24).

After all claims are submitted, the Settlement Administrator may make an offer for Class Members who qualify for payments to trade their cash payment for one or two GoAnywhere Pillows.

NOTE: If you submitted a timely and valid claim for the initial MyPillow class action settlement, you will receive an additional payment of $5.

  1. Chris says:

I received an email from the administrators, telling me to claim using the unique claim number and PIN: unfortunately, there was not unique number and PIN in the email. Informed the administrator who replied that the unique number and PIN was in the email! DO they even read their emails? Then received an email with the ‘unique number and PIN’. Unfortunately, neither number works!! Yet another scam from dishonest administrators. If you are going to provide information, TCA, you should at the very least ensure that you are dealing with a moderately honest firm!!!

  2. Ann B. says:

The point is: You can purchase a My Pillow in retail stores for $49. When you buy direct from them under their BOGO deal, you pay $98. for Two……therefore, it is not a true BOGO and is misrepresented as such. Period.

  3. Irene Matta says:

I purchased 3 my pillows at Bed Bath and Beyond. I quess that is considered non-direct purchaser but I do not see instructions how to claim under this class. Am I mistaken?

    1. david says:

You must had to receive a post card with ID and Pin in order to file a claim.

I’m going to take a wild guess and say THIS is the company that sent Scott Hardy a Cease & Desist letter.

When you overcharge, you will eventually get burned.

  6. Jim Bird says:

I have multiple My Pillows and now I will buy several more for Christmas presents. For those of you who don’t live in California like I do, the “lawyer swamp” is alive, well and vicious in your state too. It is just arrogantly more visible here because of a 70% Liberal legislature. The reason it’s 70% in a 50/50 state is because illegals vote multiple times every Election Day being bussed to several key precincts. They’re not listed on any voter rolls and many are given $100 gift cards (my tax dollars) from Target, Walmart, etc. When I received my want-to-join-the-lawsuit email, I told them to “stick it.” California is the poster child as to why Trump got elected. There’s a reason why trail lawyers donate 90% to Democrats who write these insane laws that the lawyer lobbyists bribe them with. It’s sad and they’re trying to bribe you state legislators too.

    1. Concerned says:

Amen Jim. Glad to see American consumers fully aware of the class action baloney – which only serves to make lawyers even richer.

What happened to buyer beware? Shop around, investigate before your purchase. Nonsense lawsuit

    2. Peggy Akin says:

Jim I was with you until you entered into the land of politics. This is not a Democrate or Republican issue it’s a money issue. Anything for the almighty buck!

  7. Chris Smith says:

So if we love the product and we knew what we were paying for it…. what is the problem? I agree with everyone the pillow does what it says. No more dead arm in the middle of the night from trying to keep my head up. Big thank you.

  8. john says:

This is one of the problems with America. As a business owner we have to take away resources that could be used to offer more benefits to our employees, develop more business and cut prices just to pay for liability insurance. There needs to be a cap on these types of frivolous lawsuits. Billions are spent by companies just to protect themselves. Such a waste.

  9. BARBARA VANDENBROEK says:

What a great idea Greg, I will do that! I I love “My Pillow”! Best sleep ever. Besides the fact that its a great product that actually works – its made in North America by Americans and I love that! I would have gladly paid double for these pillows. They are well made and do what they say they are going to do, which is more than I can say for a lot of other products out there. I am not sure what this legal fuss is all about but I am fairly certain it is not about making a wrong right. There are lots of wrongs out there that aren’t made right. Seems to me this one just has those right ingredients – Easy pickings? Check! Lotsa money for nothing? Check Check!

  10. Greg Popp says:

The gentleman Al further up the comment chart is probably correct. If the money has already been paid, by not receiving it, it will just build up in their coffers. We love our My Pillows, our necks aren’t sore anymore and we are thankful for what My Pillow is trying to do for the community and for our country. Wow!, a whole $6 per pillow!! We will be sending our $12 directly back to Mr. Lindell’s company. Have to something to combat this crap….
