A $1.6 million Massage Envy settlement has been reached to resolve claims that the spa denied consumers their full massage time.
The Massage Envy settlement benefits consumers who purchased a massage session at a Massage Envy location in Missouri at any time between Jan. 31, 2012 and April 13, 2020, while they were not a Massage Envy member.
Plaintiffs Mark Pirozzi and Keila Green first filed their claim in Missouri state court in April 2019. The Massage Envy class action lawsuit, which was later moved to federal court, claimed that consumers who purchased massages did not get the full benefits of their introductory or non-member offers.
According to the plaintiffs, the spa offers massages for a variety of times including one hour, one and a half hours, and two hours. These massages are reportedly offered to first time Massage Envy customers or non-members.
However, the plaintiffs claim that the massages do not last as long as advertised. Instead, the services allegedly last no more than 50 minutes, 80 minutes, or 110 minutes, respectively. Ten minutes of the appointment is used for consultation and dressing, although this time is reportedly not disclosed to consumers.
“Massage Envy misrepresented the length of massages and concealed the fact that at least 10 minutes out of the supposed massage time were spent in other activities,” the Massage Envy class action lawsuit argued.
As a result of the alleged 10 minute reductions, the plaintiffs and other consumers were forced to pay more for the massages than what they were worth.
The Massage Envy class action lawsuit argued that consumers would not have paid as much for the massage services if they had been aware that the massages were shorter than advertised.
“Members of the putative Class likewise purchased what were represented to be 1- hour, 1½-hour, and 2-hour massages as set forth above but that were in actuality no longer than 50, 80 and 110 minutes, respectively,” the Massage Envy class action lawsuit concluded. “Thus, the massages they were provided were worth less than what they paid for them.”
Massage Envy has not admitted any wrongdoing but agreed to pay $1.6 million to resolve the claims against them in a Massage Envy settlement. The deal avoids the costs and risks of continued litigation for Massage Envy, the plaintiffs, and the Class Members affected by the issue.
Under the Massage Envy settlement, Class Members will be eligible to receive a one time cash payment of $7. In order to benefit from the settlement, Class Members must file a valid claim form by July 27, 2020.
The Massage Envy settlement will also provide up to $400,000 in attorneys’ fees and costs, administrative costs of around $100,000, and incentive awards of $10,000 to the named plaintiffs.
Class Members have until July 27, 2020 to exclude themselves or object to the settlement. The final approval hearing for the Massage Envy settlement is Nov. 13, 2020.
