Korean Air Lines Co., Ltd. and Asiana Airlines Inc. have reached a $65 million class action lawsuit settlement resolving allegations they conspired to fix prices for air passenger travel between the U.S. and the Republic of Korea. If you bought a qualifying ticket between January 1, 2000 and August 1, 2007, you may be entitled to cash and coupons for future air passenger travel as part of the class action settlement.

The Korean Air settlement will resolve a class action lawsuit that claims the alleged conspiracy included meetings, conversations and communications in the U.S. and elsewhere between the two Defendants during which they agreed to establish artificially high prices for air passenger travel.

In cases separate from this class action lawsuit, brought by the United States Department of Justice, the Defendants pled guilty to criminal antitrust violations and agreed to pay a fine. Despite pleading guilty in the DOJ cases, Korean Air Lines and Asiana Airlines deny the allegations raised in the class action lawsuit but have agreed to a settlement to resolve the litigation.

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.

UPDATE 2: On Feb. 11, 2016, according to the settlement website, airline passengers who filed a claim in the Korean Air class action settlement should expect to receive a check and coupon code in April!
UPDATE 3: On April 21, 2016 the settlement website posted the following update: “We now expect that the distribution to claimants will occur in late May 2016.  Additional updates will appear on the website when the date for the distribution mailing is known. Thank you for your patience while the process is completed” Top Class Actions will continue to provide updates as we learn more. Second, PLEASE only submit claims you’re qualified for. Submitting false claims is not only illegal, it hurts the people who TRULY have a claim. Every false claim lowers the amount legitimate claimants can get, adds additional unneeded work to the settlement administrator, as they have to attempt to verify more claims (which delays payments for everyone), and it also makes settlement administrators much less likely to include internet notifications with groups like Top Class Actions as part of the advertising plan, which means YOU won’t hear about all of the settlements out there. False claims are a persistent problem and will result in less and less settlements getting listed on websites like Top Class Actions. Oh, and bragging about a false claim on social media is DUMB! Don’t you think settlement administrators are watching to see who’s dumb enough to comment or brag about doing something illegal? At a minimum those people will end up getting blacklisted and denied future claims, at a maximum you may start to see people get indicted for fraud. Remember, back in the 90s and early 2000s when we said, “They won’t ever go after anyone for downloading music illegally!” What happened? Many, MANY people got sued for thousands upon thousands of dollars and LOST.
Who’s Eligible

Class Members of the Korean Air settlement include anyone who purchased at least one ticket for air passenger travel on Asiana Airlines or Korean Air Lines. The purchase must have been:

  • Made in the United States;
  • For a flight originating in the U.S. and ending in Korean or a flight originating in Korea and ending in the U.S.; and
  • Made between January 1, 2000 and August 1, 2007.

Both businesses and individuals may be Class Members.

Potential Award

Class Members that submit a valid Claim Form will receive cash and coupons from the class action settlement, which will be distributed pro rata, based on the total number of qualifying purchases and valid Claim Forms submitted.

    Packages are being sent on the 27th. Includes check plus info on how to redeem coupons. A little dissapointing but it’s money I wasn’t counting on.

    The checks are going out Monday the 27th I have spoke to Rust myself personally. Everyone claim is different based on how many trips you made on your initial claim. I have my check amount and coupon code amount and it is not small it is a very large amount and when my check comes I will put up a pic to verify. I have knew my amounts for a while and the website will be Kpacoupon.com but it will not be up and running until the 27th. Hopefully it will all be over and we all will be paid soon!

      I did a spider on the website and nothing, I mean not even a back door webpage, I did three different SEO spider searches and nothing. i also did KALcoupon.com, kpacoupon.com and nothing. It takes 15-20 minutes to upload a website and then need to ensure all links and apps work on it, so in all reality it should be uploaded by now. It takes long to ensure the website is up and running maybe a day or two. Also, knowing what I know about websites, if it has been uploaded, say today, you can do a SEO search to find the coupon site and the links will pop up. Nothing, again, nothing absolutely nothing. Nikki why dont you say how much, again, your check is worth. So many people say they have the numbers but wont say how much…horsepucky.

    I never got an e mail from Rust today and the checks will not be mailed out on June 31. Likewise, the payout will not be $25 per claim and the coupons will not be $5 and you will not need them to be used at the same time (if you have multiple). You will not sell the coupons at a rate of .25% so you can sell them for $1.25 cash money (that is one George bill large and George coin small). You can do this on the website and have a check mailed to you (minus postage and taxes) and a small $1 fee for redemption. Now this is a joke… This is the truth…. I read on the court documents you can share the coupons with friends and family and they have a three year redemption period. There is 2.42 million in fees subtracted from the settlement for rust and chicago clearing. This means $1.075 million cash for RUST and $1.35 million in coupons for RUST. This leaves around $49ish million in cash (minus lawyer fees 25%) equals to $36.75 million to distribute that means with 86,000 claims = $426 per claim. As to the coupons 34.75 million (minus lawyer fees) = $303. I know there was an appeal to lower the lawyer fees, but it may not have been approved since the courts looked at this in Nov/13 and the lawyers requested the 25% fee in Dec/13. this is about what it appears with the court documents. If anything is more than 10% less than these numbers there is a problem… My guess its going to be a $426/$303 settlement.

      Sure, Ill give you the website so that you can bother the claims administrator and make an attempt to decrease the amount of my check by submitting a claim. Let me get the website link and ill brb

        If you are expecting a check next friday then that means the claim period is over so nobody could file to make your supposed check smaller

      There’s a lawsuit for a nondairy product that is supposed to pay out by July 30th. I’m not sure if it’s the same one since I haven’t contacted the claims administrator to see if they will pay out sooner. The checks are going to be in the $700 range if they don’t take out taxes. I applied two weeks before the deadline and only 630ish claims had been filled out at that point. The claims admin for that one updates the website to say that they were not accepting late claims

    Received check today for $63.75 .I had two flights approved.Coupon codes are worth another $100.00 .A bit disappointing but happy to have received anything at all.About time. I will be posting a picture on the Facebook page today!!
