Consumers nationwide who were affected by a data security breach incident involving Kemper Corp. and Infinity Insurance Co. may be eligible for compensation in the form of both a payment and free fraud-monitoring services thanks to a class action settlement.

Settlement Class Members include U.S. citizens who were affected by a data incident involving the Kemper Corp. and Infinity Insurance Co. that occurred Dec. 14, 2020, and March 25, 2021, and who received notifications by mail that explained their information was compromised during the incident.

There is also a Subclass for California residents.

In the class action lawsuit, plaintiffs allege Infinity Insurance Co. and Kemper Corp. were targeted in two separate security breach incidents on Dec. 14, 2020, and March 25, 2021, that resulted in the unauthorized access of the plaintiffs’ personal information. 

As a result of the data breach, the following types of information was exposed: Social Security numbers, driver’s licenses numbers, medical leaving information, and worker’s compensation claim information.

The companies confirmed the data incidents did occur Dec. 14, 2020, and March 25, 2021; the announcements were made March 16 and May 25, 2021. Despite that, they have denied any wrongdoing and do not accept legal liability for the allegations made by the plaintiffs.

Infinity Insurance Co. was founded in 1955 in Alabama. Originally, it was named Dixie Insurance Co., but it was later purchased by the Pennsylvania Co., which changed its name. By 2020, Infinity employed over 2,300 Americans and was producing over $470 million in revenue, according to Dun and Bradstreet.

Eligible Class Members can receive up to $10,000 in reimbursement for out-of-pocket expenses.

Class Members also may claim up to three hours of lost time at a rate of $18 per hour spent dealing with issues related to the breaches. If documentation is provided, Class Members may claim an additional one to three hours or at that rate, or at a rate of up to $50 per hour if they lost time at work.

They also may claim $50 if they were a California resident at the time of the data breaches

Class Members who do not take action will not get any monetary benefit from the class action lawsuit. These Members will also give up the right to pursue future lawsuits. 

Class Members who want to retain this right must exclude themselves from the Infinity Insurance and Kemper data security breach settlement Class by Jan. 25, 2022. Class Members who disagree with the settlement must notify the Court by Jan. 25, 2022.

Class Members who want the free fraud monitoring and protection services for up to 18 months do not need to submit a claim. 

Instead, these Class Members will get a redemption code by mail. 

Class Members who wish to receive their compensation must file a timely claim.

The deadline to file a claim in the Infinity Insurance and Kemper data breach class action lawsuit settlement is Feb. 24, 2022.
