Luxury shoemaker Jimmy Choo has agreed to pay $2.5 million to settle a consumer class action lawsuit alleging it violated the Fair and Accurate Credit Transactions Act or FACTA.
In October 2015, plaintiff Kerri Wood filed the class action lawsuit against Jimmy Choo, claiming that the retailer deliberately chose not to comply with FACTA by printing more than five digits of customers’ credit or debit card numbers along with expiration dates on receipts.
In her lawsuit, Wood says that she shopped at a Jimmy Choo store in Palm Beach Gardens, Florida using her MasterCard credit card. She then claims the retailer presented her with a printed credit card receipt which was bearing the expiration date of her card.
Additionally, she alleged that the credit card receipt contained other sensitive data too, such as her home address, phone number, and the name of the person who conducted the transaction. However, FACTA, which was put in place in 2003, prohibits printing either the last digits of consumer credit or debit cards or the expiration dates on the receipts.
Instead, a process of truncation must be used. In line with this, card numbers are masked with symbols such as # or * to ensure that the card holders details are kept hidden. Failure to do so can result in that merchant being charged with a FACTA violation.
Jimmy Choo tried to dismiss the case in December 2016, arguing that Wood could not prove that she was put at an increased risk for identity theft from her Jimmy Choo receipt.
Under the terms of the proposed settlement deal, Jimmy Choo will pay $2.5 million into a fund which will cover cash payments to settlement Class Members who submit timely and valid Claim Forms.
Additionally, pending Court approval, the $2.5 million settlement fund also provides Wood with an incentive award of $5,000 for her role as Class Representative and Class Counsel will receive attorneys’ fees and costs not to exceed $833,333.33.
Jimmy Choo denies these allegations and denies any claim of wrongdoing.
Class Members who wish to exclude themselves or object to the terms of the settlement must do so by March 17, 2017.
Who’s Eligible
You are a member of the settlement Class if you visited a Jimmy Choo store in the United States and paid for goods or services using a credit card or debit card between Oct. 27, 2013 and Nov. 2, 2015, and received a printed receipt that displayed a card expiration date.

Potential Award
$75 – $175
Settlement claimants could receive between $75 and $175. The approximate number of Jimmy Choo customers is more than 135,000 and the settlement payout is only an estimate. The final cash payment amount will depend on the total number of valid and timely claims submitted.
