A $3 million Jenny Craig class action settlement has been announced, resolving litigation over allegedly unlawful text messages.
If you received one or more text messages from Jenny Craig between May 7, 2014 and Sept. 6, 2018, you could get cash from the Jenny Craig unwanted texts class action settlement.
The Jenny Craig TCPA class action was filed in May 2018 alleging that marketing text messages sent by the company violated the Telephone Consumer Protection Act.
According to the Jenny Craig class action, the plaintiff received texts such as “Hi Zoey, It’s Liz @ Jenny Craig again. Don’t want you to miss our best offer ever! Free 1 yr prog. + $17 off wkly menu for 12 wks. Interested?”
Plaintiff Zoey Bloom says that she never provided her express written consent to receive telemarketing texts from Jenny Craig.
The Jenny Craig text message class action lawsuit states that Bloom experienced actual harm from the unwanted texts as they disrupted her daily life and were an aggravation and annoyance.
The TCPA protects consumers from unlawful telemarketing practices including harassing phone calls and texts without consent.
Under the TCPA, plaintiffs can collect between $500 and $1,500 per violation of the law. These violations can add up to large verdicts, leading many companies to settle TCPA allegations rather than go through with a trial.
This was the case for the Jenny Craig TCPA class action settlement.
In August 2018, the plaintiff and defendant asked the federal judge to approve a $3 million settlement benefitting a Class of individuals who received one or more text messages from Jenny Craig between May 7, 2014 and Sept. 6, 2018.
The awards for the estimated 628,610 Class Members are not yet determined, as the amount will depend on the number of valid claims submitted.
Valid Claim Forms must be submitted by March 12, 2019.
Claim Forms can be completed online at the settlement website or can be downloaded and sent through the mail to the settlement administrator.
Under the Jenny Craig TCPA settlement, plaintiff Zoey Bloom requests an award of $4,500 for her services as the Class representative.
Class Counsel intends to request up to 30 percent of the settlement fund as compensation for court costs and attorneys’ fees.
The final approval hearing for the Jenny Craig class action settlement is scheduled for Feb. 25, 2019.
Class Members have until Nov. 5, 2018 to object or exclude themselves from the Jenny Craig TCPA class action settlement.
If Class Members do not file a claim or exclude themselves, they cannot benefit from the Jenny Craig unwanted texts class action settlement and forfeit their legal rights to file future claims.
Who’s Eligible
All individuals who received one or more text message from Jenny Craig between May 7, 2014 and Sept. 6, 2018.
Potential Award
Class Members will receive an equal share of the $3 million settlement fund.

It won’t allow me to enter my phone number and this is the last day to file a claim. I for sure qualify because I use to get these text on my old number I had in 2014/2015. What am I supposed to do?
