A group of employees have secured an $8.75 million settlement in a class action lawsuit alleging iQor failed to pay its call center agents for short rest breaks in violation of the Fair Labor Standards Act.

Class Members include sales agents, collection agents, and customer care agents for iQor in the following states: Arizona, California, Colorado, Minnesota, New York, North Carolina, Ohio, and South Carolina.

Settlement periods for Class Members varies depending on the state where they worked for iQor, but ranges between 2007 and 2014.

Lead plaintiff Paris Shoots alleged in the iQor wage and hour class action lawsuit that the company, which offers customer support and product evaluation services to other companies, failed to pay him and other contact center employees for short rest breaks as required under federal and state employment laws.

According to the class action lawsuit, iQor operates 25 centers throughout the United States. It offers business services, such as product support, business analytics, accounts receivable, and other aftermarket services.

Shoots alleged that he worked for iQor in Minnesota from March 2013 until July 2014. During this time, the company used a program called “TimeQey” to track contact center employee hours.

The iQor class action lawsuit alleged that TimeQey systematically underpaid iQor employees, labeling the time as a “break” if the employee’s computer remained idle for two or more minutes.

Shoots alleged that he and other employees were not paid for short restroom breaks and even for meetings and calls when employees do not use their computer.

The iQor wage and hour class action lawsuit alleged that the TimeQey system violated state labor laws and the federal Fair Labor Standards Act (FLSA).

The FLSA and state labor laws mandate that employees be fairly paid for time that they are working. Additionally, employees must be provided reasonable meal and rest breaks.

Class Members will be able to make a claim under the terms of the iQor settlement based on the time they worked for the company and payroll data.

Class Members will be automatically enrolled for a claim based on information provided by iQor, no Claim Form or proof will need to be submitted.

However, iQor employees who want to be excluded from the terms of the class action settlement or wish to object to it, must do so no later than April 10, 2019.

Who’s Eligible

Class Members include those employed as Contact Center Agents who used TimeQey to track their hours in the following states: Arizona, California, Colorado, Minnesota, New York, North Carolina, Ohio, and South Carolina. The settlement period depends on the state where the Class Member was employed, but ranges from 2007 to 2014.

  • “Arizona Settlement Class: All individuals employed by iQor as Contact Center Agents in Arizona who used TimeQey for timekeeping purposes at any time from April 3, 2014 to December 31, 2014.
  • California Settlement Class: All individuals employed by iQor as Contact Center Agents in California who used TimeQey for timekeeping purposes at any time since February 21, 2013 to December 31, 2014.
  • Colorado Settlement Class: All individuals employed by iQor as Contact Center Agents in Colorado who used TimeQey for timekeeping purposes at any time from April 3, 2012 to December 31, 2014
  • Minnesota Settlement Class: All individuals employed by iQor as Contact Center Agents in Minnesota who used TimeQey for timekeeping purposes at any time from January 21, 2012 to December 31, 2014.
  • New York Settlement Class: All individuals employed by iQor as Contact Center Agents in New York who used TimeQey for timekeeping purposes at any time from April 3, 2009 to December 31, 2014.
  • North Carolina Settlement Class: All individuals employed by iQor as Contact Center in North Carolina who used TimeQey for timekeeping purposes at any time from April 3, 2013 to December 31, 2014.
  • Ohio Settlement Class: All individuals employed by iQor as Contact Center Agents in Ohio who used TimeQey for timekeeping purposes at any time from April 3, 2007 to December 31, 2014.
  • South Carolina Settlement Class: All individuals employed by iQor as Contact Center Agents in South Carolina who used TimeQey for timekeeping purposes at any time from April 3, 2012 to December 31, 2014.”

    I worked at iQor from June 2013 to April 2015. I got a notice about a check that I never received. I have moved since then. I called the number everyone has posted and left voicemails but no response. What do I do?

      215-563-4116 The attorneys office hired a settlement company to distribute the checks, with out telling anyone. Mine was sent to a very old address back in October 2019. No one contacted me that the check was not cashed or anything. I just contacted my attorney office and they gave me the number. You will have to have an affidavit notarized, in order to get a new check issued. I am in that process now myself.

    I’ve called and left multiple voicemails trying to get my address updated so I can get my check like my aunt did. We worked there at the same time and she has gotten hers. But no one has called me back. What do I need to do?
