A $45 million settlement has been reached in a Iowa Grain Processing Corporation class action, resolving claims that the plant was a nuisance to homeowners.
The 2012 Iowa Grain Processing Corporation class action lawsuit claimed that the company’s plant in Muscatine, Iowa was irritating to the surrounding area due to the smoke, odor, and haze which it produced. These claims were recently resolved through a settlement, in which Grain Processing Corporation will pay $45 million.
Class Members are eligible for the settlement if they meet several requirements, including:
- “You lived at a property in the Class Area for any period between April 24, 2007, and September 1, 2017; and
- You were either a renter or owner of the property, or a dependent of the property’s renter or owner during that time period; and
- You are not employed by GPC with a job title of Manager, Director, Vice President, Senior Vice President or President; and
- You did not opt out of the class action in 2017. Opt-outs include any minor child for whom no Legal Guardian remains a Class Member.”
A map of the Class Area is available on the settlement website to help consumers determine if they are eligible for participation in the settlement.
Compensation will be determined by proximity of the Iowa Grain Processing Corporation plant, level of modeled air population at the Class Member’s property, and how long the Class Member lived there.
The Iowa Grain Processing Corporation settlement will also cover the installation of anti-pollution measures at the plant over the next five years. These measures will aim to reduce emissions and odor which prompted the class action lawsuit.
Class Members who want to object to the terms of the settlement must do so by Jan. 3, 2019.
Who’s Eligible
Individuals who lived, in Muscatine, Iowa, within 1.5 miles of the Grain Processing Corporation plant located at 1600 Oregon Street, at any time between April 24, 2007 and Sept. 1, 2017.
Potential Award
$2,000 – $16,000
“The estimated payment range for Claimants who lived in the areas with the highest modeled concentrations of pollutants is $12,000 to $16,000 per individual. The estimated payment range for Claimants who lived in properties with mid-level modeled concentrations of pollutants is $6,000 to $8,000 per individual. The estimated payment range for Claimants who lived in the areas with the lowest modeled concentrations of pollutants is from $2,000 to $4,000.”

- Mortgage
- Lease
- Utility bill
- Other documentation that the settlement administration deems reliable

Called today and the claims administrator said they would be mailing out checks the last day of September
Called the claims administrator this settlement might not be closed till next yea.
Seriously? Oh man, the local newspaper was reporting checks by the end of summer.
Is there a way to contact admin to update an address??

Retired from the company and moved to Florida. I lived two blocks from the plant all those years. Submitted my claim and received a denial today saying my deed was a phoney and they further checked with local sources and stated I never lived in the town. What’s going on with RUST Administrator?
Hello I know exactly how you feel did you ever get anything. I was told just last week I don’t know what happened. They contacted me and I gave my info. And was asked questions. And now I’m not on list and Lawyer in Muscatine office just last week I talk to him and tells me he doesn’t know.i don’t accept that they did not do Thier job I’m out. Of state my self. I m very sick and ask them if they can at least Gide when I can go get help and no he said Thiers nothing to do . I feel devestetied and used. They started treating me like crap . Even yelled at me ok felt like I did something wrong. They go what they wanted out of me and now I’m dieing thinking they were going to help me. It’s a shame what lots of money can do to you . I don’t know what to do or who to talk to nobody seems to want to help me. Also call me crazy but events that actually happened to me in between now I live with though that no money no insurance can’t work sick from plant. I’m stuck and i really need to get move on it i spoke to one lawyer and my pastor people know what’s going on at least . I’m just trying to get something at least for my meds . This pain I don’t even wish it on the lawyer. Last thing I did ask was did you mess up on me . He said I don’t know . All that education masters in this that experience. No it’s just a way of doing the wrong things with a paper saying they can do it . Hope you get something cuz they sure did even said interview that money that was left over wow I’m dieing over here and can’t even take a breath loosing my eye sight got not even a dll to my name can’t work on my good day I try but my condition stops me . I think cuz you worked in plant maybe you know someone else like this it’s not fair them lawyer got tons of money from this for them to say money left over that makes me sad I guess they thought I would be dead by now but I trust God they saw me and said he’s looks to dum to find out what happened.i lost every.thing because GPC my family life home health I llive looking over my shoulder like I did something wrong but like I said they got what they wanted money . Even I Mation if you can help get for medical attention I will b have not even a pill for head ache Thier is a God andHes going to bring this situation out to light and truth is they kept most of money cuz what they gave them is something but at same time nothing. If they would of explained everything slow and not keep pressuring to answer , question and was polite and got what he needed and no more nice talk would get mad cuz I asked questions. Then everything stoped called and no answer now I have this sickness in lungs bones and now stomach. Scott mess up cuz he asked me something when I went threw event s that I said was happening my friends with me at time asked me are they after you I said I don’t know I said the only I can think off it’s the law suit I put one and two together and what Scott asked me that day is what I saw faces I remember hope this can help in future to not give money to lawyer s they are so full of envy . Ok sorry for this I just want to know if someone got help after but out of State people not the ones Thier.
Reached out to class counsel today and received the following response:
“Here’s where we are: Determination letters (regarding the claimed residences and duration of residence validated or denied) should go out within a week or so. Anyone with any portion of a claim denied will have a right to appeal. Payments (which depend in part on the number of validated claims) will be calculated and issued after the appeals are resolved. I can’t predict exactly how long this will take (as it will depend on how many appeals are filed) but we’re definitely getting closer.

I’m grown ass woman why would I lie about receiving a W-9 form? Some of ya’ll need to really grow up. It’s just a settlement. I don’t see a reason for anyone to lie about getting any document period. Who you spoke to had nothing to do with me or my claim. The ignorance is at an all time high I see…
