Intellicorp Records Inc. and Insurance Information Exchange (IIX) have agreed to pay $18.6 million to settle a class action lawsuit that accused the companies of violating the federal Fair Credit Reporting Act (FCRA). If either of these companies provided your criminal background report to an employer, you could get a cash payment of up to $2,000 from the class action settlement.
Who’s Eligible
Class Members of the Intellicorp background check settlement include all natural persons residing in the United States who were the subject of one or more consumer reports furnished to a third party by Intellicorp or IIX for employment purposes, which report(s) contained an Intellicorp Criminal SuperSearch result reflecting a record of criminal or traffic arrest or conviction or other criminal history between April 16, 2010 and Sept. 16, 2013.
Potential Award
$50-$2,000. Class Members who were the subject of a Criminal SuperSearch that contained a record of criminal or traffic arrest or conviction or other criminal history and who were not mailed a notification are eligible to receive a check for $50.
Class Members who believe their reports were inaccurate may submit a Claim Form to receive an additional payment of up to $2,000. The total amount depends on how many claims are submitted for the Intellicorp class action settlement.
Under the terms of the class action settlement, the defendants have also agreed to provide Class Members, on request with a report reflecting the criminal history information provided to employers and a copy of the information the defendants have in their files about the Class Member’s criminal history in addition to monetary compensation. They have also agreed to make substantial changes to their practices for furnishing criminal history information.

Case Summary
The Intellicorp background check settlement resolves three separate class action lawsuits that accused the companies of furnishing criminal background reports to employers that included inaccurate information and/or failing to send required notices to individuals whose criminal history information was reported to an employer, in violation of the FCRA.
Intellicorp and IIX deny the allegations and contend they acted lawfully and in compliance with the FCRA at all times. However, the companies agreed to a class action settlement, which was preliminarily approved on Nov. 25, 2013.

UPDATE: A federal judge granted final approval to the Intellicorp background check class action settlement on June 5, 2014. The first round of payments could be going out at the end of the summer/early fall and the second round in early 2015, according to some reports.

In the settlement document I believe it stated a website would be established detailing distribution of funds to whom and when and a time limited was set for that site to be up and running. Is anyone else aware of this information?
I just received email from “questions@intellicorpclassaction.com”
The Judge has approved the Settlement on June 5th. As long as no appeals are filed with the Court,
1. The first approved cash payment, which is being made ONLY to those class members who were subject to a Criminal SuperSearch but did NOT receive a notification, will be paid at the end of the summer/beginning of fall.
2. The second approved cash payment, which is being made ONLY to those class members who filed a valid claim form, will be paid in accordance with the Court’s order, AFTER the first distribution is complete. These payments are not expected to be made until the early 2015.

Getting a letter doesn’t mean you get $50…there are 2 groups
Some people were the subject of a Criminal Super Search but were not (by law) mailed a notification letter from intellicorp. They didn’t have to file a claim form.
So they should all receive a check for $50 (end Summer early Fall)
Some people may have been mailed the notification ….but their background check report had inaccurate information. They could receive up to $2000 in early 2015…but only IF THEY FILED A CLAIM FORM on the website (before the deadline)

Also, I am quite sure that after the lawyers receive their payment for services, a large chunk is automatically gone!~!!!
If i understood the letter correctly, it said that if you received the letter about the suit, you would automatically get $50. If the administrator found that your case was valid, then there was the possibillity of getting up to $2000. It does make sense that if you have a large no of people claiming that they were wronged, it would decrease the amount of monies everyone would receive.
talked to an intellicorp rep this morning. he said he had no idea where the “money would be distributed in the next couple of weeks” idea came from. he said it would be early 2015 and amount is still unknown. that was the latest update he had and to call back after holidays for further update news.
I’m curious to know just because I received a letter does that mean I will get a check?
just got on the phone with intellicorp..$50 check to be sent out in 2/3 weeks…other to be sent out in 2 months..$100 is probably the figure
so we go from up to $2000 to up to $200????

Hard to be “a bum looking for money” Obviously they were looking for a job, when they got caught up in this. I guess by being on here, your also a bum looking for money. People really need to spell.
